STATE OF TEXAS X <br />KNOW ALL MEN BY THESE PRESENTS: <br />COUNTY OF LAMAR <br />That, the City of Paris, Paris, Texas, a municipal <br />corporation hereinafter called City and Odis 0. Woodard <br />and wife, Vernon T. Woodard, of Lamar County, Texas, <br />hereinafter called Woodard do contract and agree as <br />follows: <br />1. Woodard agrees to grant a 13.3 foot wide <br />permanent easement and an additional 16.7 foot wide <br />temporary construction easement to the City of Paris <br />for the Buttermilk Creek Drainage Project, Phase II, <br />said easement being in the form of Exhibit "A" attached <br />hereto. <br />2. City agrees to pay to Woodard, SIX HUNDRED, <br />SEVENTY -FIVE AND N01100 DOLLARS ($675.00); construct <br />a five foot high chain link fence on the top of the <br />West retaining wall of said ditch; remove all dead trees <br />designated for removal by Woodard located on the lot <br />adjacent to said construction project and to remove <br />designated living trees designated by Woodard and to <br />remove living trees from the permanent easement area <br />all of which trees are to be cut in designated lengths and <br />stored in Woodard's back yard; and to deposit and spread <br />project spoils as desired by Woodard on Woodard's property. <br />3. City shall be responsible to Woodard for damage <br />done to living trees in the temporary construction <br />easement area and outside of all easement areas. <br />4. City shall spread all spoils deposited on <br />Woodard's property as directed by Woodard. <br />
