.. ` <br />u <br />357 <br />Mayor Burnett declared the public hearing open concerning Texas Power & Light <br />Company cost procedural charge as mandated by the court. Mr. Travis King, District <br />Manager, Texas Power & Light Company, appeared before the Council and recommended <br />no action be taken at this time. <br />Mayor Burnett declared the public hearing closed, and a motion was made by <br />Councilman Graham, seconded by Councilman Wortham to postpone any action at <br />this time awaiting action from the Public Utility Commission. The motion carried <br />7 ayes, 1 nay, Councilman Williams voting nay. <br />City Manager Sokoll presented a request for out -of -town water service from Curtis <br />McDaniel on Highway 82 West, and recommended that the request be approved and <br />that annexation proceedings for Mr. McDaniel's property be started. A motion <br />was made by Councilman Graham, seconded by Councilman Williams approving the <br />recommendation of the City Manager. The motion carried 7 ayes, 0 nays. <br />Fire Chief Steve Burgin appeared before the Council requesting interpretation, <br />repeal, or amendment to a recently adopted Burning Ordinance. Chief Burgin <br />stated that there were some confusion concerning interpretation of the Ordinance <br />at this time. Mr. Sam Huggins and Mr. Jerry Hanning appeared before the Council <br />stating that they would like to see the Ordinance rescinded. After discussion, <br />a motion was made by Councilman Williams, seconded by Councilman Graham to eliminate <br />all sections of the Ordinance in question which would allow burning inside the city <br />limits except in a fire proof container and specifically eliminate that part of <br />the Ordinance No. 2597, section 1, Section 12 -12 (e) which states "any acts <br />permitted by the laws of the State of Texas ". The motion carried 5 ayes, 2 nays, <br />Councilman Wortham, Councilman Kohls voting nay. <br />Mr. Bob McCarley appeared before the Council in behalf of the Retail Merchants <br />Committee recommending certain controls on out of town non -tax paying retailers <br />and requesting an Itinerant Sidewalk /Parking Lot Vendors Permit. Discussion was <br />had after which Mayor Burnett appointed a committee composed of Councilman Graham, <br />Councilman Williams, and Councilman McGee to study the situation. <br />Resolution No. 2139 renewing the contractual arrangements with the Chamber of <br />Commerce and Lamar County for promoting and advertising the City of Paris and <br />providing for the use of the Hotel Occupancy Fund was presented. A motion was <br />made by Councilman Graham, seconded by Councilman Wortham for adoption of the <br />Resolution. The motion carried 7 ayes, 0 nays. <br />
