9 31 <br />Street to a point 185 feet south. Mr. Greb had requested a permit to.pave the street <br />to a width of 39 feet in order to miss a large pecan tree which would bp in the way <br />if the street were paved to the 44 foot wide section presently designed for this <br />street. <br />Mr. Greb was present stating that a 40 or 41 foot width would be alright for his <br />plans and would permit the pecan tree to remain. He went on to say that this width <br />would also allow a power pole and fire hydrant to remain in their.present locations <br />and that they would have to be removed should a 44 foot wide section be installed. <br />It was pointed out that all recent paving in this area of 20th N. E. had been con- <br />structed in accordance with the design of 44 feet in width. <br />Councilman Williams was concerned about the future obligation to widen the street <br />should Mr. Greb be allowed to pave to a 39 or 40 foot wide section. Mr. Greb stated <br />that he would be happy to.place a cash bond with the City to replace the curb in <br />the event the-pavement is widened in the future. <br />A motion was made by Councilman Stone and seconded by Councilman Wunsch that Mr. Greb <br />be allowed to curb and gutter to a 40 or 41 foot wide section with the stipulation <br />th =- the cash bond equal to $3.60 per linear foot curbing be placed with the City. <br />In discussion, City Attorney Haynes informed the Council that such action would pro- <br />mote additional - negotiations between individuals and the Council in the event they <br />wanted to improve a street to a smaller section than was called for in the Master <br />Plan. <br />Mayor Brunette then called for the vote on Councilman Stone's motion. The motion <br />carried: 5 ayes, 2 nays. <br />City Attorney Haynes presented the following petitions for re-- zoning: H. E. Enloe <br />and Glenn Justice, part of Lot 3, City Block 102 -A, from a General Retail District <br />(GR) to a Commercial District (C); McClanahan & Holmes, Lot 1, City Block 182 -A and <br />Lot 1, Finn Place from a Multi - Family Dwelling District No. 1 to an Office District <br />(0). <br />Mayor Brunette referred the petitions to the Planning and Zoning Com€i►ission for their <br />study and recommendation and called for a public hearing at the next regular Council <br />meeting. <br />Assistant City Manager Greene presented information regarding the Texas Power & Light <br />Company rate and tariff book. Mayor Brunette stated that an ordinance was required <br />regarding this matter and called for the reading of the ordinance. <br />Ordinance No. 23310: <br />"AN ORDINANCE APPROVING'CERTAIN RATE SCHEDULES FILED BY TEXAS <br />POWER & LIGHT COMPANY IN THE CITY OF PARIS, TEXAS, AND PRO- <br />VIDING. CONDITIONS UNDER WHICH SUCH RATE SCHEDULES MAY BE CHANGED, <br />MODIFIED, AMENDED OR WITHDRAWN, AND PROVIDING FOR AN EFFEC- <br />TIVE DATE." <br />was presented. A motion was made by Councilman Wunsch and seconded by Councilman <br />Fisher for the adoption of the ordinance. The motion carried: 6 ayes, 1 nay. <br />
