921 <br />0 <br />MINUTES OF THE REGULAR MEETIMG OF THE CITY COUNCIL <br />March 14, 1977 <br />The regular meeting of the City Council was held on March 14, 1977 at "7:00 P. M. <br />Mayor Pro -Tem Ben Hinds called the meeting to order with the following Councilmen --- <br />present: George Fisher, Jr., David Philley, Freddie Swaim, Jimmy Don Stone, Walter <br />F. Williams. Also present were City Manager K. R. Sweatt, City Attorney T. K. Haynes, <br />and City Clerk H. C. Greene. <br />Prayer was offered by Reverend C. D. Hilburn. <br />Mayor Pro -Tem Hinds asked if there were any additions or corrections to the minutes <br />of previous meetings as furnished the members of the Council. There being none, the <br />minutes were approved. <br />Mayor Pro -Tem Hinds announced the first order of business would be consideration of <br />recommendations made by the Planning and Zoning Commission at its meeting held on <br />March 7, 1977. <br />Mayor Pro -Tem Hinds declared the public hearing open on the petition of Cecil Ander- <br />son for a change in zoning from a One- Family Dwelling District No. 2 to -a General <br />Retail District on Lots 8 and 9, City Block 224A. <br />Mayor Pro -Tem Hinds called for proponents to appear, and Mr. Webb Biard appeared in- <br />behalf of Mr. Anderson. Mr. Anderson appeared before the Council, and upon question- <br />ing, stated that nothing was planned for the lot immediately, but that he was "get- <br />ting prepared to put something on the lot." <br />Mayor Pro -Tem Hinds called for opponents to appear, and none appeared. <br />City Attorney Haynes presented an ordinance ordering the proposed change. A motion <br />was made by Councilman Williams and seconded by Councilman Swaim for the adoption <br />of the ordinance. Mayor Pro -Tem Hinds polled the Council after advising that a <br />3%4 vote would be necessary for the change in that the Planning and Zoning Commis- <br />sion had recommended a denial of the petition. The polling showed 4 ayes, 2 nays, <br />Councilman Philley and Councilman Hinds voting nay. Mayor Pro - Tem Hinds declared <br />the ordinance failed in that passage would require 5 affirmative votes. <br />Mayor Pro -Tem Hinds declared the public hearing open on the petition of Mathan Bell <br />for a change in zoning from a One - Family Dwelling District No. 2 to a Multi- Family <br />Dwelling District No. 1 on Lots 25 and 26, City Block 222A.. <br />Mayor Pro -Tem Hinds called for proponents to appear, and Mr. A. W. Clem appeared in <br />behalf of the petitioner, stating that one bedroom and efficiency type apartments <br />were planned for the property. <br />Mr. Robert Hayter, consulting engineer, appeared before the Council and estimated <br />that the structures and parking area would add .8% water to the drainage ditch run- <br />ning through the property. Mr. Nathan Bell was present and appeared before the <br />Council, speaking in behalf of the petition. <br />Mayor Pro -Tem Hinds called for opponents to appear, and Mr. Buddy Kammer appeared, <br />stating that he had no objection to the zoning change but was concerned with the -- <br />flooding problem. Mr. Kammer stated that he was willing to give 10 feet of his pro- <br />perty at the drainage ditch in order to assist the drainage problem. <br />
