953 <br />MINUTES OF THE REGULAR MEET?NG OF THE CITY COUNCIL <br />April 11, 1977 <br />The Regular Meeting of the City Council was held on April 11, 1977 at.7:00 P. M. <br />Mayor James M. Brunette called the meeting to order with the following Councilmen <br />present: George Fisher, Jr., Ben Hinds, David Philley, Freddie Swaim, Jimmy Don <br />Stone, and Walter F. Williams. Also present were City Manager K. R. Sweatt, City <br />Attorney T. K. Haynes, and City Clerk H. C. Greene. <br />Prayer was offered by Reverend George Broome. <br />Mayor Brunette asked if there were any additions or corrections to the minutes of <br />previous meetings as furnished the Council members. There being none, the minutes <br />were approved. <br />Mayor Brunette announced that the first order of business would be consideration of <br />recommendations made by.the Planning and Zoning Commission at its meeting on <br />April 4, 1.977. <br />Mayor Brunette declared the public hearing open on the petition of Joel May for a <br />change in zoning on Lot 9, City Block 206, from a Two - Family Dwelling District <br />(SF -2) to an Office District. <br />Mayor Brunette called for proponents to appear, and Mr. and Mrs. Joel May appeared <br />in their behalf, stating that they planned an antique shop in their residence and <br />that parking space was available. <br />Mayor Brunette called for opponents to appear, and Mro Mike Malone appeared in behalf <br />of neighbors objecting to the zoning change. Mr. Malone stated that the request <br />constituted spot zoning. Mr. Malone presented letters from five property-owners with- - <br />in 200 feet of the area requesting to be zoned, stating objections to the zoning. <br />Mayor Brunette declared the public hearing closed and an ordinance ordering the*re- <br />zoning was presented. City Attorney Haynes advised the Council that a 3/4 majority <br />would be required to pass the ordinance, in that the Planning and Zoning Commission <br />had recommended a. denial on the petition. A motion was made by Councilman Hinds and <br />seconded by Councilman Williams for the adoption of the ordinance. A poll of the <br />Council showed 6 against, 1 for the adoption of the ordinance, and the motion failed. <br />Mayor Brunette declared the public hearing open on the petition of Johnny D. Todd for <br />change in zoning on Lot 8, City Block 296, from a One - Family Dwelling District No. 2. <br />to a Neighborhood Service District. The Planning and Zoning Commission had recom- <br />mended denial of the petition. <br />Mayor Brunette called for proponents to appear, and Mr. Johnny Todd appeared in his <br />behalf, stating that a beauty shop was proposed for the location and that a mobile <br />home had been moved into the area already and was ready for utility connections. Mr. <br />Todd stated that ample parking space was available. <br />Mayor Brunette called for opponents to appear, and none appeared. <br />Mayor Brunette declared the public hearing closed, and an ordinance was presented <br />ordering the re- zoning of property in question. A motion was made by Councilman <br />Williams and seconded by Councilman Swaim to deny the adoption of the ordinance and <br />to deny the re- zoning. A poll of the Council by the mayor showed 7 for the motion, <br />none against, and the request was denied. <br />
