459 <br />.w <br />SECTION 17.09 - Public Safety Employees and Safety- Sensitive Positions <br />A. SCOPE - All public safety employees and all employees who occupy positions that require <br />a commercial driver's license and the operation of a commercial motor vehicle (even on an <br />occasional basis), and the performance of one or more safety sensitive functions as defined <br />herein, shall follow these established standards, in addition to standards set forth in the City's <br />Controlled Substance and Alcohol Abuse Policy. Personnel Department representatives will <br />assist directors in identifying covered positions. <br />B. DEFINITIONS - - <br />1. "COMMERCIAL MOTOR VEHICLE" - A motor vehicle or combination of motor <br />vehicles used in commerce to transport passengers or property if the motor vehicle: <br />a. has a gross combination weight of 26,001 or more pounds inclusive of a towed <br />unit with a gross vehicle weight rating of more than 10,000 pounds; or <br />b. has a gross vehicle weight rating of 26,000 or more pounds; or <br />C. is designed to transport sixteen (16) or more passengers, including the driver; <br />or <br />d. is of any size and used in the transportation of hazardous materials requiring <br />placards. <br />2. "PUBLIC SAFETY EMPLOYEES" - Employees who meet the following criteria: <br />a.. employees (including volunteers or reserves working as employees) of the <br />Police Department and subject to Civil Service under Chapter 143 ofthe Local <br />Government Code; or <br />b. employees of the Fire Department and subject to Civil Service under Chapter <br />143 of the Local Government Code; or <br />C. employees (including volunteers or reserves working as employees) ofthe Fire <br />Department actively engaged in providing ambulance or life - saving services, <br />to include all emergency medical technicians (EMTs), paramedics, and <br />ambulance drivers. <br />3. "SAFETY SENSITIVE FUNCTION" - Any of those on -duty functions set forth in <br />D.O.T. regulations that pertain to City of Paris activities. These include all time: <br />62 Revised 01 -25 -05 <br />
