526 <br />Under the Fair Labor Standards Act (FLSA) certain employees do not have to be paid overtime <br />compensation. Although exempt employees generally do not receive overtime compensation, they <br />are allowed some flexibility in their work schedule. Exempt employees who take time away from <br />the job in excess of one day should report that time as vacation taken for payroll purposes. <br />SECTION 14.03 — Vacations <br />Non -Civil Service regular full time employees earn one (1) day of paid vacation per month of <br />completed employment and become eligible to take accrued vacation upon successful completion <br />of their probationary period. After the tenth consecutive year of full -time employment, such <br />employees earn one and one -half (11/2) days of paid vacation per month of completed employment. <br />Forty (40) days is the maximum number of vacation days that can-be carried forward from one fiscal <br />year to the next. <br />Part-time regular employees earn paid vacation in the proportion that their regularly scheduled work <br />period bears to the regularly scheduled work week of full -time employees in the same division or <br />department. <br />Vacation leave is administered according to the following policies: <br />A. Although employees are encouraged to take vacations in full week segments, vacations can <br />also be taken in units of half -days and whole days. <br />B. Vacations may be taken at any time during the year. Vacation time, however, must be <br />scheduled in advance by the Department Head considering the needs of the organization and <br />the wishes of the employee. <br />C. Except in extraordinary circumstances, vacation time must be requested at least one week <br />in advance. <br />D. Employees being laterally transferred, promoted or demoted retain accrued vacation leave. <br />E. Vacation leave is not advanced to employees. Vacation leave cannot be transferred. <br />F. During vacation leave, the employee is paid the equivalent rate of his/her regular salary. <br />G. If a holiday falls within an employee's vacation time, the leave is not charged to vacation. <br />H. No employee may accrue more than 40 days of vacation leave. <br />I. No employee is paid for unused vacation leave if the employee leaves City employment <br />during the first year of employment.
