0006^4 <br />Regular City Council Meeting <br />January 28, 2008 <br />Page 3 <br />A Motion to approve this item was made by Council Member Wilson and seconded by <br />Council Member Fisher. <br />Gene Anderson referred the Council to the information provided in their packets. Gene said <br />a couple of months ago the City suspended a request from ATMOS for a rate increase that <br />systemwide would have raised approximately 52 million dollars. He explained the group of cities had <br />been negotiating with ATMOS and were recommending each city to approve the settlement which <br />would reduce the rate increase from 52 million to 10 million dollars. <br />Janette Moser, ATMOS Manager of Public Affairs for the Paris District, confirmed it was a <br />negotiated settlement. She said ATMOS Energy was in support of the Agreement. <br />Motion carried, 6 ayes - 0 nays. <br />(2) ORDINANCE NO. 2008-003: AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF PARIS, TEXAS, APPROVING THE PETITION OF ONCOR ELECTRIC <br />DELIVERY COMPANY LLC TO MODIFY ITS LIGHTING SERVICE TARIFF <br />PURSUANT TO THE ENERGY POLICY ACT OF 2005; MAKING OTHER <br />FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND <br />DECLARING AN EFFECTIVE DATE. <br />A Motion to approve this item was made by Council Member Biard and seconded by Council <br />Member Wilson. <br />Gene Anderson stated this would allow ONCOR Electric to bring their retail tariff policy in <br />compliance with the Federal Law that was passed in 2005. Gene said it prohibited the manufacture <br />or importation of mercury vapor ballasts after January 1, 2008. <br />Mayor Freelen announced Kevin Carruth's wife had been in an automobile accident and that <br />Kevin was going to try to be at the meeting. He apologized for not making the announcement at the <br />beginning of the meeting. <br />Motion carried, 6 ayes - 0 nays. <br />D. Consideration of and action on the following resolutions: <br />(1) RESOLUTION NO.2008 -003: A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF PARIS, TEXAS, AFFIRMING THAT THE CITY OF PARIS HAS <br />COMPLIED WITH THE REQUIREMENTS OF THE PUBLIC FUNDS <br />INVESTMENT ACT; AMENDING THE CITY'S INVESTMENT POLICY; <br />MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; <br />AND PROVIDING AN EFFECTIVE DATE. <br />
