Item No. 12 <br />memorandum <br />TO: City Council <br />John Godwin, City Manager <br />FROM: Kent McIlyar, City Attorney <br />SUBJECT: Disannexation Requests Airport Road and Wildwood Lane <br />DATE: July 9, 2015 <br />BACKGROUND: At the June City Council meeting, Boyd & Deborah Hudgens and several <br />other residents with property inside the city limits near Airport Road and Hwy 271 came before <br />the City Council and requested the Council to consider disannexing their properties from the City <br />of Paris because they do not receive city water or sewer service in that area. Mr. Godwin <br />informed the City Council that while these property owners do receive city services such as <br />police, fire and EMS, but the City does not have immediate plans to run water or sewer lines <br />down Airport Road, because there is already a Lamar County Water Supply District (LCWSD) <br />water line serving the area and there is not enough population or development in the area yet to <br />justify running long sewer lines and lift stations in the area. David Denison also appeared before <br />City Council requesting that his five acre residential lot on Wildwood Lane be disannexed from <br />the City. <br />STATUS OF ISSUE: During the last four weeks, the City has received disannexation requests <br />from the owners of approximately 27 tracts of property located inside the original 1228.89 acre <br />Tract 12 Parcel from Annexation Ordinance 1997 -059 (North side of FM 1508 /Airport Road) <br />and seven disannexation requests from property owners from Tract 8, Annexation Ordinance <br />1999 -034 (South side of FM 1508 /Airport Road). A map depicting the location of the parcels <br />requesting disannexation is included in your City Council Member packet. <br />The seven parcels south of FM 1508 /Airport Road (Tract 8) appear to meet the criteria for <br />disannexation as set out in the City's Policies and Procedures for Annexation/Disannexation <br />(adopted June 2014), as those parcels can be disannexed from the city limits without creating any <br />holes or islands outside our corporate city limits. <br />Two of the larger parcels in Tract 12 (north of FM 1508 /Airport Road) requesting disannexation, <br />Devoss #10 and Mehmeti #28, do not comply with the City's Disannexation policies because to <br />disannex them would force all property east of two tracts including the City Airport, the <br />undeveloped airport property, Agpro Property and several other developed and undeveloped <br />parcels not seeking disannexation outside the corporate city limits and break the City's <br />contiguous boundary lines. <br />
