453 City Manager Malone indicated the next item from the Traffic Commission, asking a stop sign be placed on Silverleaf at Aspen Drive, stopping north and south bound traffic on Silverleaf, was an action item. ORDINANCE NO. 2004-006 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS; TEXAS, PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF PARIS BE AMENDED BY REVISING THE TRAFFIC CONTROL MAP ADOPTED IN PARAGRAPH (b) OF SECTION 31 -65 OF SAID CODE; PROVIDING FOR A PENALTY NOT TO EXCEED $200.00; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AND EFFECTIVE DATE, WAS PRESENTED. Councilman Bell made a motion to approved the ordinance. Mayor Pro Tern McCarthy seconded the motion and it carried 7 ayes, 0 nays. Councilman Plata raised a question as to the scope of the Historic Preservation Commission's authority. He wondered if the Commission could tell a citizen what color to paint their house. Also, he wanted to know if the Commission was the final authority. He indicated a lot of citizens had questions. City Attorney Schenk related that there was a process to appeal a decision by the Historic Preservation Commission. People could appeal a denial to the City Council. The citizen, first, has to go before the Commission to get a Certificate of Appropriateness. When denied, they can appeal that decision to. the Council. City Attorney Schenk said there was. not a need for a Certificate of Appropriateness if they are repainting and not changing the color, but a color change or any exterior change requires the Certificate. Mayor Fendley said this is like any other new committee; it will take a while to get the information out to the public.
