X41 RESOLUTION NO. 2001 -007 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, DECLARING AN EMERGENCY FOR PURPOSES OF PURCHASES PURSUANT TO SECTION 252.022 OF THE LOCAL GOVERNMENT CODE REGARDING THE LOCAL DISASTER SO DECLARED BY THE CITY OF PARIS IN PRIOR RESOLUTION NO. 2001- 001; PROVIDING FOR IMPLEMENTATION OF EMERGENCY PROCUREMENT PROCEDURES; AUTHORIZING THE CITY MANAGER TO UNDERTAKE NECESSARY PROCUREMENT ACTIONS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the city of Paris, Texas, on the 25th day of December, 2000, and continuing thereafter, suffered widespread and severe damage, injury, and loss of life or property resulting from extreme winter conditions and ice storms; and, WHEREAS, the City Council of the City of Paris has previously adopted Resolution No. 2001 -001 on January 8, 2001, declaring a local disaster in the city of Paris pursuant to Section 418.108 of the Disaster Act of 1975 as a consequence of said severe winter conditions and ice storms; and, WHEREAS, as a result of said declaration, the City Council of the City of Paris has determined that extraordinary measures must be taken to alleviate the suffering of people and to protect or rehabilitate property; and, WHEREAS, the City Council finds and determines that the City has applied for emergency assistance through appropriate State and Federal agencies, and has been advised that, in order to qualify for ninety percent (90%) funding on debris removal within the city of Paris, the City must complete the process of contracting for such debris removal services and compete the actual process of debris removal by or before March 9, 2001; and, WHEREAS, because of the severe damage and the emergency need to expeditiously contract for and remove debris and undertake other activities to be performed by contractors within the city as a consequence of the aforesaid extreme winter conditions and ice storms, and to qualify for the maximum funding to assist the City in' such emergency actions, the City Council finds and determines that it is necessary to declare an emergency pursuant to Section 252.022 of the Local Government Code regarding procurements; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved.
