X41 <br />RESOLUTION NO. 2001 -007 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, DECLARING AN EMERGENCY FOR PURPOSES OF <br />PURCHASES PURSUANT TO SECTION 252.022 OF THE LOCAL <br />GOVERNMENT CODE REGARDING THE LOCAL DISASTER SO <br />DECLARED BY THE CITY OF PARIS IN PRIOR RESOLUTION NO. 2001- <br />001; PROVIDING FOR IMPLEMENTATION OF EMERGENCY <br />PROCUREMENT PROCEDURES; AUTHORIZING THE CITY MANAGER <br />TO UNDERTAKE NECESSARY PROCUREMENT ACTIONS; MAKING <br />OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND <br />DECLARING AN EFFECTIVE DATE. <br />WHEREAS, the city of Paris, Texas, on the 25th day of December, 2000, and continuing <br />thereafter, suffered widespread and severe damage, injury, and loss of life or property resulting from <br />extreme winter conditions and ice storms; and, <br />WHEREAS, the City Council of the City of Paris has previously adopted Resolution No. <br />2001 -001 on January 8, 2001, declaring a local disaster in the city of Paris pursuant to Section <br />418.108 of the Disaster Act of 1975 as a consequence of said severe winter conditions and ice <br />storms; and, <br />WHEREAS, as a result of said declaration, the City Council of the City of Paris has <br />determined that extraordinary measures must be taken to alleviate the suffering of people and to <br />protect or rehabilitate property; and, <br />WHEREAS, the City Council finds and determines that the City has applied for emergency <br />assistance through appropriate State and Federal agencies, and has been advised that, in order to <br />qualify for ninety percent (90%) funding on debris removal within the city of Paris, the City must <br />complete the process of contracting for such debris removal services and compete the actual process <br />of debris removal by or before March 9, 2001; and, <br />WHEREAS, because of the severe damage and the emergency need to expeditiously contract <br />for and remove debris and undertake other activities to be performed by contractors within the city <br />as a consequence of the aforesaid extreme winter conditions and ice storms, and to qualify for the <br />maximum funding to assist the City in' such emergency actions, the City Council finds and <br />determines that it is necessary to declare an emergency pursuant to Section 252.022 of the Local <br />Government Code regarding procurements; NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS: <br />Section 1. That the findings set out in the preamble to this resolution are hereby in all things <br />approved. <br />
