Mayor Neeley announced that the next item on the agenda was an ordinance <br />adopting the City of Paris Drought Contingency Plan in accordance with <br />requirements of Section 11.1272 of the Texas Water Code and applicable <br />rules of the Texas Natural Resource Conservation Commission, and this item <br />had been tabled at the last meeting. Mayor Neeley said a motion was <br />needed to bring this item from the table. <br />A motion was made by Councilman Manning to bring the above item from the <br />table. The motion was seconded by Mayor Pro Tern Fisher, and carried 6 <br />ayes, 0 nays. <br />ORDINANCE NO. 2000 -008 <br />AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, REPEALING <br />SECTION 34 -3 OF THE CODE OF ORDINANCES REGARDING EMERGENCY <br />RATIONING OF WATER; ADOPTING A NEW ARTICLE IV TO CHAPTER 34 OF <br />THE CODE OF ORDINANCES ENTITLED "DROUGHT CONTINGENCY PLAN <br />FOR RETAIL WATER CUSTOMERS "; ADOPTING A NEW ARTICLE V TO <br />CHAPTER 34 OF THE CODE OF ORDINANCES ENTITLED "DROUGHT <br />CONTINGENCY PLAN FOR WHOLESALE WATER CUSTOMERS; PROVIDING <br />A SEVERABILITY CLAUSE; MAKING OTHER FINDINGS AND PROVISIONS <br />RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE WAS <br />PRESENTED. <br />A motion was made by Mayor Pro Tem Fisher, seconded by Councilman <br />Pfiester, for adoption of the ordinance. The motion carried 6 ayes, 0 nays. <br />ORDINANCE NO. 2000 -009 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS AMENDING SECTION 29 -82 OF THE CODE OF ORDINANCES OF THE <br />CITY OF PARIS, PARIS, TEXAS, RELATED TO THE USE OF MARKET <br />SQUARE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALER; <br />MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; <br />AND DECLARING AN EFFECTIVE DATE WAS PRESENTED. <br />City Attorney Schenk advised the City Council that since 1933 Section 29 -82 <br />of the Code of Ordinances has been on the books referencing the use of the <br />market square for general farmer's market purposes. City Attorney Schenk <br />said the continued use of this property for farmer's market purposes has <br />significantly diminished. If the City Council will remember, the Council <br />authorized the Parks and Recreation Department to undertake a contract <br />to construct a skate park on the market square parking area. City Attorney <br />Schenk said this action is to avoid any possible perceived conflict between <br />the city's action in constructing the park and current language in the City's <br />Code of Ordinance. <br />After discussion was had, a motion was made by Councilman Manning, <br />seconded by Councilman Pfiester, for adoption of the ordinance.
