381 <br />Chambers to answer some questions that needed to be addressed. Councilman <br />Clifford returned to the council chambers. <br />Councilman McWaters said it was his understanding that these are the plats wherein <br />lots were sold before they were platted. Councilman Clifford advised that he failed <br />to call his engineer and tell him to file the plats. Councilman Clifford said it was an <br />oversight on his part and he was aware that this is a violation of city ordinance, but <br />he thought that he had done three of those lots. Councilman McWaters said that it <br />was violation of his oath of office. Councilman Clifford said he would not agree with <br />that, he just forgot and it was his mistake. Councilman Clifford pointed out that all <br />of that property is not in his name and he was entitled to a building permit on one <br />lot without a street to it anytime to build his house. Councilman Clifford said he has <br />received notice from the City that he had 30 days to get this plat filed, and this is <br />what he is doing tonight, correcting his mistake. <br />After further discussion, a motion was made by Councilwoman Fisher to allow <br />Councilman Clifford to remain in the council chambers. The motion was seconded <br />by Councilman McWaters, and carried 5 ayes, 0 nays. <br />Mack Ross asked to be allow to speak before the City Council concerning the issue <br />on the floor. After discussion, a motion was made by Councilman McWaters, <br />seconded by Councilman Gray, to allow Mr. Ross to speak. The motion carried 5 <br />ayes, 0 nays. <br />Mr. Ross stated that there has been a lot said about the rule of law by Councilman <br />Clifford and Mayor Pro Tern Thomas. Mr. Ross said that Mr. Clifford has violated the <br />ordinance back to 1994 and pointed out several alleged incidents. <br />City Attorney Foster advised that if Mr. Clifford has met the requirements of the City <br />Engineer and there has been a finding that he has by the Planning and Zoning <br />Commission. City Attorney Foster further advised that without finding that the <br />Planning and Zoning Commission is wrong, and if Mr. Clifford has met the <br />obligations, the City Council does not have to act, and the plans and plat will be <br />automatically approved. <br />After further discussion, a motion was made by Councilman Boyd, seconded by- <br />Councilman Gray, approving the final plat of Lots 36 and 35, Block L, Lots 6 and 3, <br />Bock K, and Lots 6 and 7, Block J, Oak Creek, Part of Phase VII, subject to the <br />requirements of the City Engineer.
