�3 <br />meeting was over, their recommendation was for a 25 foot front yard, and he thought <br />that Mr. Swaim was in agreement with that. Mr. Smith said the property is currently <br />zoned Single Family -3 which did allow and require a 25 foot front yard, and Mr. <br />Swaim submitted a Plat showing a 10 foot front yard which is 21 feet from the curb. <br />Mr. Smith further advised that his memo with the Plat is for approval; however, based <br />on the action of the Planning and Zoning Commission, and depending on the action of <br />the Council, that memo may have to be revised to change the front yard, and his <br />recommendation was to follow the ordinance. <br />Eddie Vincent, 330 421" N. E., came forward telling the Council that he was present <br />representing an interest in family property that joins Mr. Swaim's lots. Mr. Vincent <br />said where Mr. Swaim street dead -ends, it dead -ends into their property which is being <br />considered for new development at this time. Mr. Vincent said he made a point to go <br />to Cedar Park and take a look at what Mr. Swaim had done there, and what he is <br />asking you to do here tonight. Mr. Vincent said it was his opinion it is very unsightly <br />for carports to be that close to the street, and when we have an ordinance in this City <br />that has been enforced for many years with a minimum of a 25 foot setback line from <br />the City property which in effect is a 36 foot setback line from the back of the curb. <br />It was his understanding that many people that have built carports and encroached <br />upon this line have had to tear them down, and in some cases, people have actually <br />been fined for doing this same thing. Another point Mr. Vincent made was Mr. Swaim <br />bought these lots as developed lots, developed subdivision, and it has always been his <br />understanding that Planned Development was to be used when you take a piece of raw <br />land and you wanted to develop your own scheme of plan for that land, and to his <br />knowledge, the only time that Planned Development has been used in the City of Paris <br />has been a situation where the street goes in and dead -ends into that person's property <br />and has no effect with the continuation of the street. Mr. Vincent said Mr. Swaim is <br />using the concept of Planned Development to obtain a variance to the ordinance, and <br />he was extremely concerned about the value of their property. Mr. Vincent asked for <br />the Council's support in this matter. <br />Eric Clifford also appeared before the Council telling them that he bought these lots <br />from Eddie Vincent, and sold them to Mr. Swaim, and he owns the only house out <br />there. Mr. Clifford said he has no objection to moving the building line, but it was up <br />to the Council, although, he did not object to the movement of it, it will not effect his <br />property. <br />No one else appeared, and the public hearing was declared closed. <br />
