City Manager Malone presented a resolution authorizing the execution of a deed <br />for approximately 3.53 acres being part of Lot 2, City Block 322, located in the <br />1700 Block of N. E. Loop 286 to Patt Swaim as consideration for right -of -way <br />to be used for construction of Martin Luther King, Jr. Drive located between 5th <br />Street N. E. and 3rd Street N. W. <br />City Attorney Haynes pointed out that the Council declared the Loop property <br />to be surplus property in 1989. The City had this property actively on the <br />market, and there was on contract for it, but the contractor backed out on the <br />contract, and that is the only person showing any interest in this property in the <br />seven years that it has been on the market. City Attorney Haynes said that the <br />part of the property that would be left has more frontage on the loop. <br />Mayor Cliffcrd said in his opinion, the loop property should be kept all together. <br />After discussion, a motion was made by Councilman Thomas to table action on <br />the resolution until additional information can be received. <br />A. W. Clem, Attorney, came forward telling the Council that he has been <br />working on this for a while in order to get this expedited because Mr. Swaim's <br />health is not good, and this is one of the reasons why this should be followed <br />through. Mr. Clem said the property that he is giving up an area that will permit <br />the continuation of the 3rd Street right -of -way, a small amount for 1St Street N. <br />W., and the continuation of MLK across North Main Street. Mr. Clem said that <br />if this goes on for a while then it may be a while before it could be completed. <br />After further discussion, Mayor Clifford seconded the motion to table action on <br />this item. The motion failed with 3 ayes, and 3 nays. <br />After additional discussion, a motion was made by Councilwoman Elder for <br />approval of the resolution for execution of a deed for approximately 3.53 acres <br />being part of Lot 2, City Block 322, located in the 1700 Block of N. E. Loop 286 <br />to Patt Swaim as consideration for right -of -way to be used for construction of <br />Martin Luther King, Jr. Drive located between 5th Street N. E., and 3rd Street N. <br />W. The motion was seconded by Councilman Fulbright, and failed with 3 ayes, <br />3 nays. <br />Resolution No. 98 -005, authorizing and directing the Mayor of the City of Paris, <br />Eric S. Clifford, to execute a special warranty deed conveying in accordance with <br />the laws of the State of Texas, the City's interest in the closing alley located in <br />City Block 11, beginning in the south boundary line of City Block 11, 100 east <br />of the southwest corner of said City Block 11; thence north 98.5 feet; thence east <br />116 feet to the west boundary line of 0 Street N. E. to the adjacent owners on <br />either side of said alley, it appearing that the real and true owners of the <br />described lots are Lots 2, 3, 41% 4A, and 5, City Block 11, was presented. A <br />motion was made by Councilman Thomas, seconded by Councilman Fulbright <br />for approval of the resolution. The motion carried 6 ayes, 0 nays. <br />
