M MUTES OF THE REGULAR MEETING OF THE CITY COUNCIL <br />MARCH 10, 1997 <br />The City Council of the City of Paris met in a regular session, Monday, March 10, 1997, 6:00 P. M., <br />City Council Chambers, City Hall, Paris, Texas. Mayor Eric S. Clifford called the meeting to order with <br />the following Council Members present: Charles Fulbright, Alan Boyd, Charlie Neeley, and Thetis <br />L. Elder. City Manager, Michael E. Malone, City Attorney, T. K. Haynes, and City Clerk, <br />Mattie Cunningham was also present. <br />Invocation was given by W. E. Anderson, Director of Finance for the City of Paris. <br />City Manager Malone presented the minutes of the Planning and Zoning Commission's meeting <br />held March 3, 1997, and attached hereto as Exhibit A to these minutes. <br />City Manager Malone called for consideration of and action on authorizing the preparation of <br />an ordinance closing the alley located between Booth Street and Tudor Street from the West <br />boundary line of 19' Street N. E. West to the East Boundary line of 17' Street N. E. <br />City Manager Malone explained that General Law Cities are required to have the agreement of <br />all property owners adjacent to a street or alley being closed. Home Rule Cities such as the <br />City of Paris are not required by law to have the agreement of all of the property owners, <br />however; it has been the policy of the City of Paris to only close alleys at the request of (by <br />petition) all the property owners adjacent to the alleys or fronting streets. City Manager <br />Malone further explained that there were two out -of -town property owners who have been <br />mailed the request telling them that this is going to be presented to the City Council and that <br />if the City did not hear from them by March 30', then it would be presumed they were in <br />agreement. <br />After discussion, a motion was made by Councilman Boyd, seconded by Mayor Pro Tem. <br />Fulbright authorizing preparation of an ordinance closing the alley located between Booth <br />Street and Tudor Street from the West Boundary line of 19' Street N. E. West to the East <br />Boundary line of 17' Street N.E. The Motion carried 5 ayes, 0 nays. <br />Mayor Clifford declared the public hearing open to consider the petition of Bobby Smallwood <br />for a change in zoning from an Agricultural District (A) to a Commercial District (C) on Lot <br />11, City Block 321, located in the 1700 Block of F. M. 195. <br />Mayor Clifford called for proponents to appear, and Bobby Smallwood, 1135 Levi Lane, <br />appeared in behalf of his petition. Mr. Smallwood told the Council that there is no city water <br />or sewer at this location, and the people who owns the property does not want to spend the <br />money for this service. Mr. Smallwood said he would like to purchase the property if the <br />zoning could be change to commercial. They plan to clean the property up, there is an old <br />
