• • <br />by law and by charter. <br />Mr. Ross said that the contract between the City and a person, is the City, the City Manager, or the <br />City Council? <br />City Attorney Haynes advised that if it is a contract, then, execution of contracts, unless there has <br />been a resolution passed that authorizes someone other than the Council to handle certain matters. <br />ffthe Council has placed that authority upon the City Manager or another person, like occasionally <br />the City Council will direct him to procure right -of -way, then he is acting for the Council. If they turn <br />over the gray area to the City Manager, then the City Manager would have full authority for that, but <br />the execution of contracts, it has been the City's practice, and it is his opinion, that each contract that <br />has to be executed needs to be authorized by the City Council. This will make it an official act of the <br />City Council. <br />Mr. Ross wanted to know if Mr. Haynes has the letter that he wrote back last year in July regarding <br />his request for purchase of raw water that was sent over to the City Manager. He did not receive a <br />copy of it, and stated that it has not been signed by the City Manager. <br />City Attorney advised that he did not have the letter, that he did sent a letter to the City Manager, <br />then he found out that everyone was talking about several different things. City Attorney Haynes said <br />he was only talking about one thing, and that was in regard to Mr. Ross's recreational activity, which <br />Mr. Ross told him that he had already had conversation with the Director of Utilities, and with the <br />supervisor of the sewer treatment plant. Mr. Haynes said Mr. Ross said he needed help taking care <br />of the sewer that was going to be generated by an activity that was going to entertain people. City <br />Attorney Haynes advised that his information in his office is confidential between him and the City <br />of Paris, and does not go out of the office. <br />City Manager Malone advised the Council that Mr. Ross has not presented any drawing, plans, <br />specifications nor filed a formal request. With regard to raw water, City Manager Malone said Mr. <br />Ross had told him that he had made a request by asking that a letter be signed stating that the City <br />would give him raw water from the raw water supply line from Pat Mayse Lake to Paris, and stated <br />that he was told that he could take raw water from a valve, and it could be calculated as to how much <br />water would come out of that size valve. City Manager Malone said that is not true. City Manager <br />Malone said there were several problems associated with the sale of raw water. One is, anytime we <br />sale someone raw water, we will have a meter which they will have to provide. City Manager Malone <br />said the City puts potassium permangana in the raw water from time to time for taste and odor <br />problems, and he would have great concern about what the water is to be used for, and Mr. Ross <br />informed City Manager Malone that the water would be use in his jet ski races. City Manager Malone <br />pointed out that the City of Paris could possibly be sharing in some type of liability in the event that <br />someone became sick <br />City Manager Malone said the property in question is outside the extraterritorial jurisdiction of the <br />
