STATE OF TEXAS ) <br />COUNTY OF LAMAR ) <br />711 <br />AGREEMENT <br />City of Paris <br />CSJ: 0901 -29 -012 <br />Paris Santa Fe- Frisco Railroad <br />Depot Rehabilitation <br />THIS AGREEMENT is made by and between the State of Texas, acting by and through <br />the Texas Department of Transportation, hereinafter called the "State," and the City of Paris, <br />Paris, Texas, hereinafter called the "City. to <br />WITNESSETH <br />WHEREAS, the International Surface Transportation Efficiency Act of 1991 (ISTEA), <br />codified under Title 23 U.S.C. Section 101 et seq., establishes the National Intermodal <br />Transportation System that is economically efficient and environmentally sound, provides the <br />foundation for the nation to compete in the global economy, and will move people and goods in <br />an energy- efficient manner; and, <br />WHEREAS, Title 23 U.S.C. Sections 133(d)(2) and 160(e)(2) require that ten percent <br />(10 %) of certain funds apportioned to a state pursuant to Title 23 U.S.C. Section 104(b)(3) be used <br />for transportation enhancement activities, as defined in Section 101(a) of Title 23 U.S.C.; and, <br />WHEREAS, the Texas Transportation Commission, hereinafter called the "Commission," <br />will use those funds in a statewide competitive program that enhances the intermodal transportation <br />systems and facilities within the state for the enjoyment of the users of those systems; and, <br />1 <br />EXHIBIT A <br />
