176() <br />been told wrong about what they had said in the certificate, none of <br />the reasons were listed in that section of the Charter as it exist. <br />Mr. Conder said today when he talked to Mr. Haynes about this, he <br />mentioned where it said his address was not on the affidavit, and the <br />committee of petitioners were on it. Mr. Conder said the Charter did <br />not specify that these things have to be on the affidavit. Later on in <br />the conversation with Mr. Haynes he identify the last paragraph in this <br />as his opinion, but if the Charter has never been amended officially to <br />reflect these changes that are set forth in that certificate of <br />insufficiency. Mr. Haynes has rendered an opinion about why this <br />petition would be filed as insufficiency, this is an opinion that comes <br />from a man, first of all, put two things in there that he thought that <br />was in the charter, or advised Ms. Cunningham to put them in there, and <br />it turned out not to be in the Charter, second, he put an opinion in <br />there making a kind of an unofficial Charter amendment that the people <br />have never voted on. Mr. Conder recommended to the Council to consider <br />this when they consider Mr. Haynes's opinion because we have a choice <br />at this point if the Council votes this down, we can drop it or pursue <br />legal action, and he said he was too hardheaded to drop it. Mr. Conder <br />said in 1994 City Election there were 215 votes cast, 1995 there were <br />525 votes cast making a combined total of 740 votes. This petition was <br />filed on December 18, 1995 bears the signature 757 confirmed registered <br />voters, and if I happened to be a member of this Council, and <br />especially if I had to be a member of this Council who is facing <br />re- election this year, I think it would carry some weight with me. <br />A motion was made by Councilman Fulbright to find the initiative <br />petition invalid and not to terminate or call for the termination of <br />the City Manager. The motion was seconded by Councilman Bell, and <br />carried 6 ayes, 0 nays. <br />City Manager Malone called for consideration of and action on calling <br />an election on the initiative ordinance calling for the termination of <br />the City Manager. <br />City Attorney Haynes advised the Council that the petition is <br />insufficiency and there is no legal reason to call an election, so <br />therefore, he recommended to the Council that an election not be called. <br />A motion was made by Councilman Bell, seconded by Councilman Fulbright <br />to not call an election on the initiative ordinance calling for the <br />termination of the City Manager. The motion carried 6 ayes, 0 nays. <br />Martha Bone, 580 33rd S. E., came forward telling the Council that she <br />hoped that each one of the Councilmen would recognized the fact that <br />there are concerned people, and the Council lit the match with the high <br />water and sewer rate. Ms. Bone said all this mess that we hear and we <br />see, and the absolute evil that is going on, it's not going over the <br />heads of the common people, and she wished that the Council would take <br />into consideration, you know this Charter is sudden the bible when it <br />favors Mr. Haynes and the Council, but you can not get a fair shake <br />when you are just an ordinary voting citizen.
