008 RESOLUTION NO. 94 -025 WHEREAS, the City Council of the City of Paris did heretofore in Resolution No. 93- 110, passed on October 28, 1993, accept the bid presented in the form of an Earnest Money Contract - Commercial Unimproved Property from Bobby Smallwood and Glenn Townes, dated June 30, 1993, and authorize preparation of a deed for Lot 6, City Block 276, being 4.14 acres, more or less; and, WHEREAS, Bobby Smallwood and Glenn Townes are no longer desirous of continuing with said Contract and have requested the City Council of the City of Paris to approve the execution of an assignment of the Earnest Money Contract - Commercial Unimproved Property to Terry Kilgore and wife, Linda Kilgore; and, WHEREAS, it has been brought to the attention of the City Council that Lot 6, City Block 276, and Lot 2, City Block 322, have heretofore been used as a trash dumps and burn sites, and that the marketability of said lots is in question and could be improved by the procurement of class 1 and 2 environmental assessments, as needed; and, WHEREAS, the City Council desires to continue to contract for the sale of said property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that it does hereby accept the Assignment and Amendment to Earnest Money Contract - Commercial Unimproved Property from Bobby Smallwood and Glenn Townes to Terry Kilgore and wife, Linda Kilgore. BE IT FURTHER RESOLVED, that the Mayor of the City of Paris, George Fisher, be, and lie is hereby, authorized and directed to execute on behalf of the City of Paris the Assignment and Amendment to Earnest Money Contract - Commercial Unimproved Property in the form of Exhibit A attached hereto. BE IT FURTHER RESOLVED, that the City Attorney, T. K. Haynes, be, and he is hereby, authorized to procure a class 1 and 2 environmental assessment on Lot 6, City Block 276, and Lot 2, City Block 322, as needed.
