A motion was made by Councilman John Bell, seconded by Councilman Jim Bell authorizing preparation of an ordinance amending Chapter 34, Section 34 -131, Subsection (c) (6), a) b) and c) of the Code of Ordinances establishing the waste hauler permit and disposal at P.O.T.W. and the manifest system. City Attorney Haynes advised the Council that it has been customary to set fees in the ordinance itself that requires the fee. The ordinance requested by the utility department in a form promulgated by E. P. A. provided for the establishment of fees in a separate resolution which was also passed by the City Council at the request of the administration. In attempting to use the ordinance, we find that the standard method used by the City of Paris is superior to that of E. P. A. and we have prepared amendments to the ordinance in order that a person may be informed of the fee by looking in one place rather than having to look at the ordinance and then searching for a resolution which is not in anyway referenced in the ordinance. A motion carried 6 ayes, 0 nays. Councilman John Bell asked to be excused from the Council meeting due to conflict of interest. A motion was made by Councilman Jim Bell, seconded by Councilman Shelton excusing Councilman John Bell. The motion carried 5 ayes, 0 nays. C.
