3 <br />Earl Smith advised the Commission that technically speaking he did <br />not have any problem with the homeowner maintaining the creek area, <br />but was concerned about future responsibility if the homeowner <br />association failed. <br />This matter was discussed at length and Mr. Clifford made a motion <br />to recommend approval of the preliminary plat subject to the <br />requirements listed in City Engineer's Memorandum dated February 1, <br />1993, marked Exhibit B and attached hereto with the further <br />condition that the City Attorney formulate wording to be placed in <br />the homeowner's requirements absolving the City from responsibility <br />and liability of drainage way maintenance. Mr. Hayter seconded the <br />motion which carried 7 ayes, 0 nays. <br />The Final Plat of Lots 6, 7 and 7 -A, City Block 43 was recommended <br />for approval on a motion by Mr. Fendley, seconded by Mr. Powell <br />subject to the requirements in City Engineer's Memorandum dated <br />February 1, 1993, marked Exhibit C and attached hereto. The motion <br />carried 7 aye, 0 nays. <br />The Commission heard presentations from J.T. Dunkin of J.T. Dunkin <br />and Associates and from H.O.R. Inc. representatives Donal Simpson, <br />Joseph Pobiner and Richard Leisner, all of Dallas, pertaining to <br />proposed Master Plan needs. Each firm presented their views on the <br />needs and goals Paris might pursue and outlined the methods they <br />would recommend to achieve them. Each consultant spent <br />approximately 30 minutes in their presentations. <br />There was no other business to consider and the meeting was <br />a journed. <br />e N.
