RESOLUTION N0. 90 -016 <br />WHEREAS, the City Council of the City of Paris did <br />heretofore in Resolution No. 89 -137 award the bid and authorize <br />the execution of a contract with K Mart Corporation for <br />furnishing of labor and materials and performing all work <br />required for servicing City of Paris vehicles; and, <br />WHEREAS, said K Mart Corporation has failed to perform in <br />accordance with the terms of the contract; and, <br />WHEREAS, the City Council recommends that the second lowest <br />bidder, Kwik Kar Lube, 3235 Lamar Avenue, Paris, Texas, be <br />awarded the bid; NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, <br />That the contract heretofore entered into with K Mart Corporation <br />is cancelled and held for naught. <br />BE IT FURTHER RESOLVED, That the Mayor of the City of Paris, <br />Eric S. Clifford, be, and he is hereby authorized and directed to <br />execute on behalf of the City of Paris the contract for labor and <br />materials for servicing City of Paris vehicles with Kwik Kar <br />Lube, upon the terms and conditions and in the form shown in <br />Exhibit A attached hereto. <br />Passed and adopted this 12th day of February, 1990. <br />ATTEST: <br />Mattie Cunningham, City Clerk <br />APPROVED AS TO FORM: <br />T.
