1 y RESOLUTION NO. 86 -018 WHEREAS, the City Council of the City of Paris, has undertaken a project of construction entitled "33 -Inch Treated Water Pipeline Project" in accordance with plans and specifications prepared by Shimek, Jacobs and Finklea, Consultant Engineers of Dallas, Texas, for a treated water transmission line from City of Paris Lake Crook Water Treatment Plant south to Campbell Soup plant; and, WHEREAS, the easement descriptions necessary for the completion of said 33 -Inch Treated Water Pipeline Project are shown on Exhibit A attached hereto; and, WHEREAS, the City Council finds that the above described utility easements are necessary for said improvement project and that the same should be condemned; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the City Attorney, T. K. Haynes, be, and he is hereby authorized and directed to proceed to condemn the above described property to be used for the 33 -Inch Treated Water Pipeline Project. Haynes, City Attorney Resolution No. 86 -019 resolving that the City Council of the City of Paris hereby waive the City of Paris' right to terminate the agreement with Merico, Inc. provided for in Section 3.4 of Article III of said agreement conditioned and subject to Merico, Inc.'s waiver of its rights to terminate was presented. A motion was made by Councilman Wilson, seconded by Councilman Burnett for adoption of the Resolution. The motion carried 7 ayes, 0 nays.
