1 <br />y <br />RESOLUTION NO. 86 -018 <br />WHEREAS, the City Council of the City of Paris, has <br />undertaken a project of construction entitled "33 -Inch <br />Treated Water Pipeline Project" in accordance with plans and <br />specifications prepared by Shimek, Jacobs and Finklea, <br />Consultant Engineers of Dallas, Texas, for a treated water <br />transmission line from City of Paris Lake Crook Water <br />Treatment Plant south to Campbell Soup plant; and, <br />WHEREAS, the easement descriptions necessary for the <br />completion of said 33 -Inch Treated Water Pipeline Project <br />are shown on Exhibit A attached hereto; and, <br />WHEREAS, the City Council finds that the above <br />described utility easements are necessary for said <br />improvement project and that the same should be condemned; <br />NOW THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, That the City Attorney, T. K. Haynes, be, and he is <br />hereby authorized and directed to proceed to condemn the <br />above described property to be used for the 33 -Inch Treated <br />Water Pipeline Project. <br />Passed and adopted this 24th day of February, 1986. <br />G rge i her, J ., Mayor <br />ATTEST: <br />Mattie Cunningham, City Clerk <br />APPROVED AS TO FORM: <br />T. Haynes, City Attorney <br />Resolution No. 86 -019 resolving that the City Council of the City of <br />Paris hereby waive the City of Paris' right to terminate the agreement <br />with Merico, Inc. provided for in Section 3.4 of Article III of said <br />agreement conditioned and subject to Merico, Inc.'s waiver of its <br />rights to terminate was presented. A motion was made by Councilman <br />Wilson, seconded by Councilman Burnett for adoption of the Resolution. <br />The motion carried 7 ayes, 0 nays. <br />
