L <br />C. L. Walker was present concerning 3 lots in Eastfield Estates which had been <br />sold to individuals. He stated he felt obligated as the developer of the sub- <br />division to pay for the assessment on Lot 1 and 20, Block C and Lot 1, Block D <br />of Eastfield Estates. He requested, however, that he only be assessed $3.00 per <br />front foot instead of $5.00 per foot due to the fact that he could have constructed <br />the curb and gutter along Pine Mill Road for that price at the time he developed <br />the other streets in the subdivision, but did not do so at the request of the City. <br />Director of Public Works, Darrell Gunn, explained the method used to determine <br />assessment costs on both 7th N. W. and Pine Mill Road. <br />City Attorney Haynes stated that proper notice was given to adjacent property <br />owners along both streets and City Manager Sokoll stated his opinion that the <br />adjacent properties were enhanced in value by the paving to a greater degree <br />than the assessment placed on the property. <br />Mayor Malone declared the public hearing closed and <br />ORDINANCE NO. 2546 <br />AN ORDINANCE CLOSING THE HEARING GIVEN TO THE REAL AND TRUE OWNERS OF PROPERTY <br />ABUTTING UPON A CERTAIN STREET IN THE CITY OF PARIS, TEXAS, WITHIN THE LIMITS <br />HEREINAFTER DEFINED, AS TO SPECIAL BENEFITS TO ACCRUE TO SAID PROPERTY AND <br />THE REAL AND TRUE OWNERS THEREOF BY VIRTURE OF IMPROVEMENT OF SAID STREET <br />WITHIN SAID LIMITS, AND AS TO ANY ERRORS, INVALIDITIES OR IRREGULARITIES IN <br />ANY OF THE PROCEEDINGS OR CONTRACT THEREFOR: OVERRULING AND DENYING, ALL PROTESTS <br />AND OBJECTIONS OFFERED; FINDING AND DETERMINING THAT EACH AND EVERY PARCEL OF <br />PROPERTY ABUTTING UPON SAID STREET WITHIN THE LIMITS DEFINED WILL BE SPECIALLY <br />BENEFITED AND ENHANCED IN VALUE IN EXCESS OF THE AMOUNT OF THE COSTS OF SAID <br />IMPROVEMENTS PROPOSED TO BE AND AS ASSESSED AGAINST SAID PROPERTY AND THE REAL <br />AND TRUE OWNERS THEREOF, AND LEVYING AN ASSESSMENT FOR THE PAYMENT OF A PORTION <br />OF THE COSTS OF IMPROVING SAID STREET WITHIN SAID LIMITS DEFINED, FIXING A <br />CHARGE AND LIEN AGAINST SAID PROPERTY AND THE REAL AND TRUE OWNERS THEREOF, <br />FIXING THE MANNER AND TIME OF PAYMENT THEREOF, AND PROVIDING FOR THE MANNER <br />AND METHOD OF SAID PAYMENT <br />was presented. A motion was made by Councilman Burnett, seconded by Councilman <br />Kyle for adoption of the Ordinance.
