(DK10, DC4 - FHP /mlb - VII - 2/28/80 - rev) Lease 189558 THIS SUPPLEMENTAL, AGREEMENT, dated this 14th day of April , 1980, by and between SOUTHERN PACIFIC TRANSPORTATION COMPANY, a corporation (Licensor), and CITY OF PARIS, a municipal corporation of the State of Texas (Licensee). RECITALS: By an agreement dated January 14, 1980, Licensor permitted Licensee to construct, maintain and operate that certain eight -inch (811) diameter pipeline for the conveying of water beneath certain property of Licensor located in the City of Paris, Lamar County, Texas, in the location and in accordance with the construction details indicated on the print attached thereto and made a part thereof. The parties desire to modify said agreement of January 14, 1980, as hereinafter provided. AGREEMENT: Licensee is hereby permitted to construct, reconstruct, maintain and operate, subject to the terms of the said agreement of January 14, 1980, a twelve -inch (12 ") diameter cast iron water pipe within a fifteen-inch (1511) diameter steel casing pipe in lieu and in place of the said eight -inch (81) diameter water pipeline subject to the said recited agreement. The above specified twelve -inch (12 ") diameter pipeline, together with its casing pipe, shall be deemed to be the structure defined in the said agreement of January 14, 1980, and as hereinafter used. Said structure shall conform to the construction details indicated on the print of Licensor's Drawing No. 79 -9072, as revised February 4, 1980, attached and made a part hereof. This agreement shall take effect as of the 14th day of April , 1980. Except as herein otherwise provided, all terms and conditions of said recited agreement shall continue in effect. IN WITNESS WHEREOF, the parties hereto have caused this supplemental agreement to be executed in duplicate the day and year first herein written.
