: 385 <br />LEASE AND AG[tEEVIENT <br />STATE OF TEXAS 0 <br />KNOW ALL MIEN BY THESE PRESENTS: <br />COUNTY OF U MAR 0 <br />THIS LEASE AGREEMENT, made and entered into this 9th <br />day 'of June, 1975, by and between the CITY OF PARIS, Paris, Texas, <br />a municipal corporation, hereinafter called LESSOR, and KENI'�;ETII <br />GIFFORD, of Lamar County, Texas, hereinafter called LESSEE, <br />WITNE SSE TH: — <br />For the term and consideration, and upon the terms, specifi- <br />cations and conditions herein prescribed and specified,. LESSOR does <br />hereby let and lease to LESSEE, KENNETH GIFFORD.,* all that portion <br />of Culbertson Park, a- recreation area owned. by said CITY OF PAINS, <br />bounded on the Forth by Neathery Street, bounded on the East by 17th <br />Street, S. E. , bounded. on the -South by East Hearon Street, and bounced <br />on the West by a fence running due North and South from Neathery <br />Street to East Hearon Street, which fence is located on the West Side <br />of the miniature golf course now existing on the area involved, being <br />the area now under fence on the extreme East portica of Culbertson <br />Park. <br />The term of this lease shall be for a period of three (3) years <br />from and after November 1, 1974, that is from November 1, 1974 <br />through October 31, 1977, at which time and on which date the same <br />shall terminate, unless sooner terminated as herein specified and <br />provided, during which term LESSEE may and shall occupy the same <br />and use the same as an amusement and recreation center, and for <br />no other purpose, on consideration of and for which, LESSEE, <br />KENNETH GIFFORD, contracts, agrees and obligates himself, his <br />heirs and assigns, that he will pay and deliver over to the City <br />Clerk of the City of Paris, monthly, on the 1st day of each month <br />hereafter, during the term of said lease, a certified statement of <br />the gross receipts accruing to and from the operation of the amuse- <br />ment center and each facility thereof for the immediately preceding <br />month, therewith paying and delivering to the City of Paris as rental . <br />or lease money a sum equal to ten per cent (10 j) of said gross re- <br />ceipts, income from the operation of the miniature golf course, or <br />any other amusement placed on and used in the aforesaid property. <br />In consideration whereof, LESSOR and LESSEE mutually- agree <br />as follows: <br />(1) That LESSOR let and lease to LESSEE the above de- <br />scribed prop --r. ty and premises at the rental and for the terra anil <br />consideration hereinabove set out, and upon the covenants and con - <br />ditions herein specified. <br />(2) If LESSEE shall at any time abandon such leased property <br />and premises, or shall by any means evidence_ his desire or intention <br />to c case to operate thereat and thereon an amusement and recreation <br />' :�,. at its o t-ion c anc. 1 this Ie �� b , ctio <br />c:.nic.r, thin L.,l•?SS01.� :? � � r , � :_. �? ,._. . n of <br />1.t� 13:),-1y, shrct1d on tiT lil[[T "l1tC:i Of Si[c'ST <br />v.- i,![out Habili[v to LE'SS1 1-;, his hairs or assigns, Ind is st,_i. ovcw <br />J <br />1.1;SSOR st[ail he entitled to and may disposc, pis it MLly ; ee tit, of <br />any and all hnprovements or egtupnzcnt located. thereon- <br />EXHIBIT A <br />
