A Motion to move item I 21 <br />forward was made by Council Member Frierson and seconded by Council Member Drake. <br />Motion carried, 7 ayes — 0 nays. <br />14. Convene into Executive Session pursuant to Section 551.071 of the Texas Government <br />Code, Consultation with Attorney, to receive legal advice from the City Attorney about <br />pending or contemplated litigation and /or on matters in which the duty of an attorney to <br />his client under the Texas Disciplinary Rules of Professional Conduct of the State Bar of <br />Texas clearly conflicts with this chapter, as follows: <br />• Development Corporation Act; <br />• Ranger Abbott, 125 41St S.W. <br />Mayor Hashmi said the Ranger Abbott matter was going to be postponed to a later date. <br />Mayor Hashmi said he understood there was legal advice with regard to the Development <br />Corporation Act, but that it was not pending or contemplated litigation and asked why it was in <br />executive session. Mr. McIlyar said because the item fell under Section 551.071 for legal <br />advice. Mayor Hashmi convened City Council into executive session at 6:05 p.m. <br />15. Reconvene into open session and possibly take action on those matters discussed in <br />Executive Session. <br />Mayor Hashmi reconvened City Council into open session at 6:49 p.m. and announced <br />that item 13 would be placed on at a future agenda. Mayor Hashmi said he would like to discuss <br />the Development Corporation Act and asked Mr. McIlyar to give a brief history. Mr. McIlyar <br />said the Economic Development Corporation and the Paris City Council worked together on <br />economic development projects and recently there had been questions of whether expenditures of <br />4A tax money needed to go before the City Council for approval on each and every instance. <br />Mr. McIlyar said he did believe that State Law required that. He also said there was history that <br />City Council had tried to review and approve significant economic development corporation <br />projects. Mayor Hashmi asked for comments from PEDC Board Chairman Doug Wehrman. <br />Mr. Wehrman said PEDC was aware of the people's money, He also said that sometimes <br />decisions had to be made very quickly with regard to incentives to get or retain industry and that <br />through the years the PEDC budget was approved by the Council. He suggested that the Council <br />place a dollar figure of over $500,000 on projects that had to go to Council. Mayor Hashmi said <br />it was the role of the City Council and required by State Law that Council approve the PEDC <br />budget and the budget contained line items for projects. He also said Council needed to make a <br />decision if they wanted to put a dollar amount on projects that had to be brought to Council for <br />approval. Council Member Wright said that everyone wanted the same goals, which included <br />more jobs. He said everyone realized PEDC funds were taxpayer's money and that everyone <br />realized they could call a special meeting within seventy -two hours if needed. <br />
