AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
<br />AMENDING ZONING ORDINANCE NO. 1710 TO ESTABLISH THE MH
<br />MANUFACTURED HOUSING DISTRICT; AMENDING SECTION 3-100,
<br />"ZONING DISTRICTS ESTABLISHED"; AMENDING THE OFFICIAL LAND
<br />USE MATRIX TO ALLOW INDIVIDUAL HUD -CODE MANUFACTURED HOMES
<br />IN THE MH DISTRICT AND THE SF -3 ONE -FAMILY DWELLING DISTRICT,
<br />ESTABLISHING DISTRICT AND SUPPLEMENTAL DEVELOPMENT
<br />STANDARDS; AMENDING CHAPTER 4, SECTION 4.08.003, "ALLOWABLE
<br />LOCATIONS FOR MANUFACTURED HOMES AND MOBILE HOMES," TO
<br />REMOVE THE PROHIBITION AGAINST AUTHORIZED INDIVIDUAL HUD -
<br />CODE MANUFACTURED HOMES; EXPRESSLY PRESERVING THE
<br />EXISTING REGULATIONS FOR MANUFACTURED HOME PARKS,
<br />MANUFACTURED HOME SUBDIVISIONS, RECREATIONAL VEHICLES,
<br />TRAILERS, AND OTHER SPECIAL VEHICLES; PROVIDING A REPEALER
<br />CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY
<br />CLAUSE; PROVIDING A PENALTY CLAUSE; AND PROVIDING AN
<br />EFFECTIVE DATE.
<br />WHEREAS, the City of Paris is a home -rule municipality operating under the
<br />Constitution and laws of the State of Texas and possesses authority to regulate zoning, land
<br />use, development, public infrastructure, subdivision, utilities, construction, fire safety, and
<br />related matters within its jurisdiction to protect the public health, safety, and welfare; and
<br />WHEREAS, the City has adopted Zoning Ordinance No. 1710, codified as Chapter 9,
<br />Exhibit 9B, "Zoning Ordinance," of the Code of Ordinances of the City of Paris, Texas, which
<br />regulate the use of land, buildings, structures, and premises within the City; and
<br />WHEREAS, HUD -code manufactured homes constructed on or after June 15, 1976, are
<br />regulated under federal manufactured housing construction and safety standards and constitute
<br />a distinct form of residential housing; and
<br />WHEREAS, the City Council finds that individual HUD -code manufactured homes
<br />provide an important housing option and should be allowed in appropriate residential districts
<br />subject to objective zoning, installation, appearance, parking, utility, and occupancy standards;
<br />and
<br />WHEREAS, the City Council desires to establish the MH Manufactured Housing District
<br />for individually owned residential lots and to allow individual HUD -code manufactured homes in
<br />the SF -3 One -Family Dwelling District; and
<br />WHEREAS, the City Council intends at this time to preserve, without substantive
<br />amendment, the City's existing regulations governing manufactured home parks, manufactured
<br />home subdivisions, recreational vehicles, trailers, and other special vehicles pending the
<br />adoption of the Paris Development Code; and
