<br />DRAFT <br />F:ATTORNEY\ORDWORK\CURRENT\ Waste Management Ord Amend Sec 16-21(b) 2 <br />ORDINANCE NO. __________ <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, AMENDING ARTICLE II TO CHAPTER 16, SECTION <br />16-21 (b) OF THE CODE OF ORDINANCES OF THE CITY OF PARIS <br />REGARDING THE DESIGNATION OF THE CITY AS THE EXCLUSIVE <br />PROVIDER OF RESIDENTIAL GARBAGE COLLECTION SERVICE; <br />MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE <br />SUBJECT; AND DECLARING AN EFFECTIVE DATE. <br />WHEREAS, <br /> the City of Paris as a Home Rule City is authorized under state law to <br />regulate and control solid waste collection and disposal within its city limits; and, <br />WHEREAS, <br /> Section 12 of the City Charter of the City of Paris authorizes the City <br />Council by ordinance to adopt and prescribe rules and regulations and fix charges and <br />compensation to be charged for the removal, handling, and disposition of all garbage, trash, and <br />rubbish within the city limits of the City of Paris; and, <br />WHEREAS, <br /> Section 16-21 (b) of the Code of Ordinances of the City of Paris designates <br />the City as the exclusive provider of residential garbage, rubbish, and waste collection and <br />disposal services for all residential units within the City Limits of the City of Paris; and, <br />WHEREAS, <br /> the City Council has identified a short-fall in the general revenues of the City <br />of Paris and specifically a short-fall in the revenues generated for solid waste collection; and, <br />WHEREAS, <br /> the City Council has authorized the City Manager to initiate various actions <br />intended to generate additional revenue or reduce cost to the City operations; and, <br />WHEREAS, <br /> among those activities considered by the City Council for the City Manager <br />to pursue is a contract related to collection and disposal of solid waste; and, <br />WHEREAS, <br /> the City Manager has sought proposals from various qualified waste <br />disposal firms related to various arrangements for the collection and disposal of solid waste in the <br />City of Paris; and, <br />WHEREAS, <br /> as a result of the process of competitive pricing and negotiation, the City <br />Manager has received a proposal from Waste Management, Inc., the nation’s largest waste <br />management company, to contract for residential solid waste disposal service within the City, <br />whereby the City would continue to provide customer billing and account control and Waste <br />Management, Inc. would provide the remainder of the services; and, <br />WHEREAS, <br />Waste Management, Inc. has stated its intent that if the City so contracts <br /> <br />
