which was approved by the commission and council only in the last several weeks, as well as <br />the contiguous neighborhood which we think should not be encumbered by the many possible <br />incompatible uses available in Commercial, we cannot support this request. <br />Public hearing declared open. <br />George Fisher, owner of the subject property spoke in favor of the petition stating when the <br />Dollar Tree built that shopping center they contacted him because they were not interested at <br />the time in the nearly 7 acres behind it. Fisher states he bought the property because he was <br />younger then and had bigger aspirations at that point in time. The current owners of the Dollar <br />Tree property are interested in rejoining that property. Fisher states he has a 30 -foot <br />ingress/egress across their parking lot that says nothing about him needing to fix any damage or <br />anything. Fisher states that Dollar Tree has expressed no plans for the property other than to <br />shut the easement down and whenever they decide to sell the property it would be sold as one <br />piece of property at that time. Fisher states he has a contract to sell that would be null and void <br />if the zoning change does not go through. <br />Roger Shipp resides at 3745 Leigh Dr. spoke in opposition of the petition due to the run off of <br />water and trash from the easement that either this property owner or the City owns that floods <br />him out every time it rains. He has had damage to his property foundation. Shipp further states <br />before anything is developed at this property that backs up to his, the easement needs to be <br />addressed. His neighbor's driveway is ruined because of the flood waters. Shipp asked what <br />are the plans to get rid of the water, brush, trees, trash etc. <br />Chairman Flowers states the commission has no authority at this time to address the <br />development and drainage issues. This agenda item is regarding the zoning of this property. <br />James O'Bryan commented that development may improve some of these issues versus an <br />undeveloped property. <br />Public hearing was declared closed. <br />Motion was made by James O'Bryan, seconded by Chad Lindsey to deny the zoning change. <br />Motion carried 5-1 with Keith Flowers in opposition. <br />
