Regular Council Meeting <br />September 23, 2019 <br />Page 3 <br />City Engineer Carla Easton explained that the applicant Lisa Short wanted to continue <br />her income tax office and that the proposed zoning change was to an Office District for that <br />purpose. Ms. Easton said the future land use plan called for this lot be retail and that Planning <br />and Zoning recommended approval of the zoning request, as did city staff. <br />Mayor Clifford opened the public hearing and asked for anyone wishing to speak in <br />support or opposition to this zoning change, to please come forward. <br />Lisa Short, 3206 Bonham, spoke in support of this item. She said she had been in <br />business for over twenty years, had never any complaints, and there were several other <br />businesses on that street. Sherry Pritchard, 96 -32nd N.W., spoke in support of this item and said <br />that the future land use map supported the zoning change. She also said Ms. Short was issued a <br />permit and she paid her taxes. Jessica Nation Holtman, 100 N. Main, said she was there on <br />behalf of the Moore Law Firm and that the Shorts were their clients. Ms. Holtman said there was <br />a lawsuit between the Shorts and Ms. Smithey, who was Kim McCann's mother. In summary, <br />she said the lawsuit was about a disputed property line. Kim McCann, 3220 Bonham, said some <br />of the allegations that Council heard were not true, and asked them to deny the zoning change <br />request. She said this was a neighborhood dispute. James O'Bryan, 3150 Bonham, said he was <br />a neighbor and also had a business attached to his property. He said that had not been a problem <br />until now. He also said there were three churches on the street. Dr. O'Bryan said none of the <br />people who signed the petition was at the meeting, but that all of the people there were <br />supporting Ms. Short. <br />With no one else speaking, Mayor Clifford closed after the public hearing. Mayor <br />Clifford said his opinion was that to shut Ms. Short's business down after all these years would <br />be a disservice. Council Member Hughes wanted to know if it was proper for a business to <br />operate a parking lot or utilize the street. Ms. Easton said if it were a new business, a parking lot <br />would be required. She said with it being a seasonal business, they were not concerned about <br />parking. Dr. O'Bryan said Ms. Short could use the beauty shop parking lot and the neighboring <br />church parking lot. Council Member Pilgrim agreed with Mayor Clifford and stated the future <br />land use map allowed this change. Council Member Stone asked everyone to stand up who was <br />there to support Ms. Stone, and then asked those who did not support Ms. Short, to stand up. <br />Council Member Stone apologized to Ms. Short about the way she voted the last time this was <br />before them, and said she noted that those who signed the petition did not show up to this <br />meeting. Council Members Portugal and Knox both said they were sticking with their original <br />votes. <br />A Motion to approve the zoning change was made by Council Member Portugal and <br />seconded by Council Member Stone. Motion carried, 6 ayes — 0 nays. <br />11.
