d. Change Orders can only be approved by the OWNER. <br />1) Work performed on the proposed contract modifications prior <br />to the approval of the Change Order will be performed at the <br />CONTRACTOR's risk. <br />2) No payment will be made on Change Orders until approved <br />by the OWNER. <br />C. The CONTRACTOR may be informed that the proposed modification is not approved <br />and construction is to proceed in accordance with the Contract Documents. <br />1.09 EMERGENCY WORK <br />A. Notify the ENGINEER immediately of any additional work that must be performed to <br />prevent injury or damage to existing structures, facilities, utilities, or work in place. <br />B. When possible, obtain authorization from the ENGINEER before proceeding. <br />1.10 CLAIMS <br />A. Do not perform any work that is considered to be outside the scope of the Contract <br />Documents without an approved Change Order. <br />B. File notices of claims with the ENGINEER within ten (10) days of the event that gave <br />rise to the claim. <br />C. Provide full documentation within thirty (30) days of the notice. <br />D. Items not reported within the stipulated time will not be considered. <br />1. Failure to notify the ENGINEER of potential claims does not allow the <br />OWNER to take alternative action to prevent the CONTRACTOR from <br />incurring the cost for the item or to perform the work in a different manner. <br />2. Failure to notify the ENGINEER does not allow operations to be monitored <br />for the actual cost of performing the Work. <br />E. When full documentation has been received by the ENGINEER, the claim will be <br />reviewed in the context of the Contract Documents. <br />1. If the claim is believed to be valid, a Change Order will be prepared and <br />payment of the Change Order will be recommended. <br />2. If the claim is not believed to be valid, then the claim will be denied with an <br />explanation of the reasons. <br />3. Should the CONTRACTOR disagree with the decision of the OWNER, the <br />CONTRACTOR may refuse to do the Work. <br />a. If the OWNER insists that the work be done, proceed with the work <br />on a time and materials basis. <br />b. The validity of the claim will be resolved at a later time in accordance <br />with the Contract Documents. <br />1.11 RECORD DRAWINGS <br />A. Maintain at the site one (1) complete record copy of: <br />1. Drawings. <br />2. Specifications. <br />3. Agenda. <br />4.
