A. Substitutions are defined as any product that the CONTRACTOR proposes to provide <br />for the Project in lieu of the specified product. <br />E•• Submit the following for consideration of approval of a Supplier or product which is not <br />specified: <br />1. Contract Modification Request for deviation from the Contract Documents per <br />Paragraph 1.08 and Section 01 31 00 — Project Administration. <br />2. Prove that the product is acceptable as a substitute. Itis not the ENGINEER's <br />responsibility to prove the product is not acceptable as a substitute. <br />a. Indicate on a point by point basis for each specified feature that the <br />product is acceptable to meet Contract Documents requirements. <br />b. Make a direct comparison with the specified Supplier's published data <br />sheets and available information. Provide this printed material with <br />the submittal. <br />C. The decision of the ENGINEER regarding the acceptability of the <br />proposed substitute product is final. <br />3. Provide a typewritten certification that, in making the substitution request, the <br />CONTRACTOR: <br />a. Has determined that the substituted product will perform in <br />substantially the same manner and result in the same ability to meet <br />the specified performance as the specified product. <br />b. Will provide the same warranties and/or bonds for the substituted <br />product as specified or as would be provided by the Manufacturer of <br />the specified product. <br />C. Will assume all responsibility to coordinate any modifications that may <br />be necessary to incorporate the substituted product into the project <br />and will waive all claims for additional Work which may be necessary <br />to incorporate the substituted product into the Project which may <br />subsequently become apparent. <br />d. Will maintain the same time schedule as for the specified product. <br />C. Pay engineering cost for review of substitutions. <br />Cost for additional review time will be billed to the OWNER by the ENGINEER <br />for the actual hours required for the review and marking of Shop Drawings by <br />ENGINEER. Cost for the additional review shall be paid to the OWNER by the <br />CONTRACTOR on a monthly basis. <br />A. Submit warranties and guarantees required by the Contract Documents with the Shop <br />Drawings or record data. <br />B. Provide additional copies for equipment and include this additional copy in the <br />Operation and Maintenance Manuals. Refer to Section 01 78 23 Operation and <br />Maintenance Data. <br />C.
