Page 4 <br />4. The developer shall install a minimum six (6') f3. privacy fence along the West <br />property line from Lamar Avenue to the SW Corner of Building 3. <br />5. The developer shall comply with all other State and Local Regulations and Policies <br />for the development prior to issuance of all permits and Certificates of Occupancy. <br />6. The SUP shall expire one (1) year from date of approval, unless extended for up to <br />an additional one (1) year by the City Council, unless a site construction and <br />building permit for the first phase has been applied for and approved by the City. <br />A number of inputs have been received and shared with the Commission. Andrew turned <br />the presentation over to Todd Mittge, City Engineer. Mittge states during the platting and <br />engineering plan review process they will closely monitor design calculations, runoff <br />control and detention pond features. This includes storage volumes. Mittge states as a <br />condition for any development to the western and southern border that engineering <br />recommends drainage and all other construction activities be required to comply with City <br />Ordinances. <br />The public hearing was declared open. The following citizens were opposed citing flooding <br />concerns and existing drainage problems: <br />Pat & David Bolton, 205 SE 251h Street <br />Betty Slayden, 235 SE 25th Street <br />Doris & Larry Redus. 260 SE 26th Street <br />Crystal Prescott 2605 Hubbard Street <br />Pann Sriben, Development Engineer spoke in favor, stating the housing study shows <br />demand for dwelling units and they want to construct high-end living units with retail. <br />Sriben further states that they will be addressing detention with a 1 -foot curb wall. Water <br />will be run to the pond and not flowing to the neighbors. They will be discharging at the <br />current water rate. There will be no water coming from the roof line. They will be doing <br />everything to keep water from shedding to another property. Sriben states they will have a <br />tree mitigation plan and will surround the property with a fence. They will comply with <br />City regulations and produce a quality product. <br />Commissioner Robert Spain asked the City Engineer if a retaining wall will be placed <br />behind building #6. Mittge states that is a detail he does not know so he differed the <br />question to Pann Sriben. Inaudible response from Sriben as he was not at the podium <br />microphone. Mittge states that the 1 -foot retaining wall that is planned will work but he <br />cannot give a 100 percent assurance that it will not cause additional flooding in this <br />neighborhood because we cannot predict uncertain amounts of rain. Mittge believes that <br />they can control the 25 -year event that our ordinance requires and he is in discussion with <br />the developers to exceed that. With no one else speaking the public hearing was declared <br />closed. <br />A Motion to approve this item with noted conditions was made by Board Member Chance <br />Abbott and seconded by Board Member Adam Bolton. Motion carried, 6 ayes — 0 nays. <br />
