shall only be presented by, and permits issued to, the owner or <br />the owner's authorized representative of the land upon which <br />the fire is to be kindled. The Fire Code Official may revoke any <br />permit that is found not to be in compliance with this section, <br />causing said permit to be null and void and any fees related to <br />the permit shall not be refunded. <br />Permits and permit holders shall also comply with: <br />1. Texas Commission of Environmental Quality rules and <br />regulations. <br />2. State or local, temporary or permanent bans on open <br />burning. <br />3. Local written policies as established by the Fire Code <br />Official. <br />(22) Section 307.2.1 shall be amended to read as follows: <br />307.2.1 Authorization. All outdoor burning shall be done in <br />accordance with this Code and Texas Outdoor Burning Rule <br />Title 30 Texas Administrative Code (30 TAC) Sections 111.201 <br />through 111.221. If a conflict should arise between this code <br />and the Texas Outdoor <br />Burning Rule Title 30 Texas Administrative Code (30 TAC) <br />Sections 111.201 through 111.221, then the more stringent <br />rule shall apply. Where required by state or local law or <br />regulations, open burning shall only be permitted with prior <br />approval from the state or local air and water quality <br />management authority, provided that all conditions specified <br />in the authorization are followed. <br />(23) Section 307.2.2 shall be added to read as follows: <br />307.2.2 Restricted Outdoor Burning. It shall be unlawful for a <br />person, firm, or corporation to ignite or burn materials when <br />the Fire Code Official or other proper authority has determined <br />a "No Burn Day". <br />(24) Section 307.4 shall be amended to read as follows: <br />307.4 Location. The location for open burning shall not be less <br />than 300 feet from any structure, and provisions shall be made <br />to prevent the fire from spreading to within 300 feet of any <br />structure. <br />10 <br />
