2. State or local, temporary or permanent bans on open <br />burning. <br />3. Local written policies as established by the Fire Code <br />Official. <br />Section 3072.1, Authorization, shall be amended to read as follows: <br />All outdoor burning shall be done in accordance with this <br />Code and Texas Outdoor Burning Rule Title 30 Texas <br />Administrative Code (30 TAC) Sections 111.201 through <br />111.221. If a conflict should arise between this code and the <br />Texas Outdoor Burning Rule Title 30 Texas Administrative <br />Code (30 TAC) Sections 111.201 through 111.221, then the <br />more stringent rule shall apply. Where required by state or local <br />law or regulations, open burning shall only be permitted with <br />prior approval from the state or local air and water quality <br />management authority, provided that all conditions specified in <br />the authorization are followed. <br />Section 307.2.2, Restricted Outdoor Burning, shall be added to read as <br />follows: <br />It shall be unlawful for a person, firm, or corporation to <br />ignite or burn materials when the Fire Code Official or other <br />proper authority has determined a"No Burn Day". <br />Section 307.4, Location, shall be amended to read as follows: <br />The location for open burning shall not be less than 300 <br />feet from any structure, and provisions shall be made to prevent <br />the fire from spreading to within 300 feet of any structure. <br />Exceptions: <br />1. The minimum required distance shall be 150 feet <br />from structures that are under the legal control of the <br />permit holder, provided that such qualifying <br />structures contain no sensitive receptors and have an <br />exterior surface made entirely of non-combustible <br />material. <br />2. The Fire Code Official may reduce the required <br />distance in circumstances where he deems is safe to <br />do so. This exception does not apply to disposal fires. <br />10 <br />w U~006L, <br />
