41 envelope or box containing the proposal must be enclosed inside an outer envelope or box <br />42 addressed as specified in the proposal. <br />43 <br />44 In case of ambiguity, duplication, or obscurity in the bids, the City reserves the right to construe <br />45 the meaning thereof. The City further reserves the right to accept any proposal or reject any or <br />46 all proposals and to waive defects or irregularities in any proposal that the City Council may <br />47 deem to be in the best interest of the City. Any proposal may be withdrawn prior to the <br />48 scheduled 3:00 p.m. Friday, October 14, 2010 opening of the proposals or authorized <br />49 postponement thereof. Any proposal received after 3:00 p.m. Friday, October 14, 2010 will not <br />50 be considered. <br />51 <br />52 Each bid must be accompanied by appropriate proposal security in the form of a certified or <br />53 cashier's check or an approved bidder's bond made payable unconditionally to the City in the <br />54 amount of fifty thousand dollars ($50,000.00) as a guarantee that, if awarded the contract, the <br />55 bidder shall enter into a contract and execute all necessary bonds. Checks and bonds will be <br />56 returned promptly after the City and the selected Contractor have executed the Contract, or, if no <br />57 Contractor's Proposal has been selected within ninety (90) days after the date of the opening of <br />58 the Proposals, upon demand of the Contractor at any time thereafter, so long as he has not been <br />59 notified of the acceptance of his Proposal. <br />60 <br />61 Refusal to execute the contract in accordance with the proposal or the failure to give such bonds <br />62 as may be specified in the Contract documents shall cause forfeiture of the proposal security set <br />63 out above without necessity of court action or any other formality. <br />64 <br />65 Each proposal must be accompanied by a certificate of insurance evidencing the coverage set <br />66 forth in Section 16 of the General Specifications. <br />67 <br />68 Performance and payment bonds are to be submitted on the forms provided as part of the <br />69 Contract Documents. Performance bonds are to be in the amount of not less than one hundred <br />70 percent (100%) of the contract price for one (1) year, conditioned upon the faithful performance <br />71 of the contract, and upon payment of all persons supplying labar or furnishing materials. Bonds <br />72 shall be executed by a surety company authorized to do business in the State of Texas. Owner <br />73 shall approve bonds as to form. The Owner may, in its discretion, reject a surety it believes <br />74 unacceptable; a failure to reject a surety who is unacceptable or fails to perform its obligations <br />75 shall incur no liability to Owner. <br />76 <br />77 If any person contemplating submitting a bid is in doubt as to the meaning of any part of the <br />78 plans, specifications, or other proposed contract documents, he may submit to the City's contact <br />79 a written request for an interpretation thereof prior to seven (7) days of the time of opening of <br />80 bids. The person submitting the request will be responsible for its prompt delivery. Any <br />81 interpretation of these documents will be made only by addendum duly issued and a copy of such <br />82 addendum will be mailed or delivered to each person receiving a set of such documents.
