H. Except for reconshuction or other required intermptions, the homeowner must provide all existing <br />utilities for use by the contracWr (as they relate w the consduction) and must be responsible for <br />contiauous maintensnce and payment of existing utilities. <br />1.8. In order to meet TDHCA Standards, contractors are responsible for, and must meet minimum requirements <br />as follows: <br />A. AIl contiactors muet cany and provide proof of a current general liability policy of at least one <br />hundred thousand dollars ($100,000).. This policy should cover all work dont under the HOME <br />program and be pro-paid througb the period of the contracL No geographic, time or other <br />limitation that excludes the HOME pragracn will be acceptable. <br />B. All contractors must be verified by TDHCA as not being debarred by the Federal Goverament. <br />Any contractor who is cnrrently debarred will not be eligible for payment and should not become <br />party to a HOME Program fiutdcd project. <br />C. Wheaever possible, Contract Administrators will give opportunities W Historically Underutilized <br />Businesses (HUBS) and will malce an affirraadve effort to eneourage bids from such contractors. <br />D. Whenever possible, opportunities must be given to localty ovmed buainesses and low-income <br />residents of a given area. This must be established in a"Local Opportunity (Section 3) Plan." <br />E. In addition to t6ese requirements, a Contract Adminishator may establish his/her own fair and <br />evenly applied criteria for contractor selection. These may include but are not limited ta; <br />1. Workers compensation insurence; <br />2. Verificadon of quality of work references; <br />3. Verification of credit referenees, and; <br />4. Verification of established line of credit <br />1.9 An approved contractor list may be croated bat must be accessible w atl applicants who meet the fair and <br />reasonable criteria pre-established by the Contract Administrator. Such criteria should be published as an <br />element of the Program Policy and Procedures and must be made available in writing upon demand by <br />intcresteci parties. It is recommettded that the published criterie, along wiih an advertisement to bid, be <br />posted in a public place. Any advertisement to bid shouid allow reasoaable time for an interested party to <br />mcet the criteria required by the Gontract Administrator. <br />1. 3 0 Conttactors will be selected through an itemized bid process. A sealed bid is the preferred method for <br />selecting bids. If the modified bid process is beiag followed, the homeowner may seleet any bid that is <br />within 15% of the cost estimate. Iiowever, the low bid is always preferred and the homeowner shoutd state <br />their preference for a higher bidder in writing. If the homeowner has deferred contiactor seiection to the <br />Contract Administratar the lowest and best bid will be selectad. <br />1.11 Contrectors will adhere to the tenns of the rehabilitation contact including these performance standards <br />and the general specifications. Whenever the need for clarification results in a change, suc6 issues will <br />result in a writtan change order prior to any work being completad. No work will be approved except that <br />which is estabfished in the contract and in written approved change orders. Any unforoswn or hidden <br />condition should be reported to the Conhact Administrator immediately. Any itcm that conflicts with these <br />staadards should be reported immediabely by the contiactor. <br />1.12 Whenever possible the contractor will make an effort to minimize the impact of the eoitsttvction on the <br />TDHCA- Home Investrnent Pertrnerships Program Page 3 of 23 <br />AQpendix A-03 - TMC Standards Revised 01/01/2004 <br />
