meaning, he should at once notify the Engineer in order that a <br />written addendum may be sent to all bidders. Any addenda <br />issued prior to 24 hours of the opening of bids will be mailed <br />or delivered to each contractor contemplating the submission of <br />a proposal on this vvork. The Proposal as submittecl by the Con- <br />tractor will be so constructed as to include any addenda, if <br />such are issued by the Engineer prior to 24 hours of the Bid <br />Opening. <br />SC. 12 Engineer's Authority and Duty <br />Reference is made herein to Section 2.02 of the GENERAL COI3- <br />DITIONS OF AGREEMENT. The first two sentences of said <br />Section 2.02 are hereby deleted and replzced with following: <br />"Unless otherwise specified, it is mutually agreed between <br />the parties to this B.greement that the ENGINEER shall in- <br />spect all work included herein. Inspection of the work by <br />the ENGINEER shall not relieve the CONTRACTOR of his ob- <br />ligations necessary to insure the proper execution of the <br />contract. The ENGINEER shall have the authority to stop <br />the worlt whenever such stoppage may be necessary in his <br />opinion for the protection of the interests of its Owner. <br />It shall be the complete responsibility of the CONTRACTOR <br />to supervise and manage his operations." <br />All other sentences and paragraphs of said Section 2.02 shall <br />remain and govern the Contract as stipulated. <br />SC. 13 Right of Engineer to modify Methods and Equipment <br />Section 2.13 of the GENERAL CONDIiIOtd5 OF AGREEMENT shall be <br />deleted. <br />5C. 14 Protection Against Accident to Employees and the Pubiic <br />The last sentence of Section 3.09 of the GEN'ERAL CONDITIONS <br />of AGREEMENT is hereby modified to read as follows: "The CON- <br />TRACTOR and his sureties shall indemnify and save harmless the <br />Oj9I3ER, the ENGINEER, and all their officers, agents, and <br />employees from all suits, actions, or claims of any character, <br />name and description brought for or on account of any injuries <br />or damages received or sustained by any person or persans or <br />property, on account of any negligent act or fault of CONTRACTOR, <br />his agents or employees, in the execution of said contract; or <br />on account of the failure of the CONTRACTOR to provide necessary <br />barricades, warniny lights or signs; and will be required to pay <br />any judgement, with costs, which may be obtained against the <br />OWNER and/or ENGINEEP, growing out of such injury or damage. " <br />All other sentences and paragraphs of said Section 3.09 shall <br />remain stipulated. <br />SC-3 <br />
