The Architect, acting as the Owner's designated agent for design of this Project, shall be <br /> the sole judge of whether the Contractor's proposed substitution is equal and shall <br /> make his judgment in accordance with the following criteria: <br /> <br /> 1. Whether substitution proposed conforms with description or performance <br /> criteria specified. <br /> <br /> 2. Whether substitution supports the restoration and rehabilitation goals for the <br /> project, according to the Secretary of the Interior Standards for Rehabilitation, as <br /> interpreted by the Texas Historical Commission and the Architect. <br /> <br /> 3. Whether substitution proposed is equal or superior in quality. <br /> <br /> 4. Whether substitution proposed is comparable in appearance and historic <br /> authenticity and/or compatibility, where these are considerations. <br /> <br /> 5. Whether substitution proposed affords comparable operation, maintenance, <br /> and performance. <br /> <br /> 6. Whether substitution proposed will provide equal or greater longevity and <br /> service under conditions of climate and usage. <br /> <br /> 7. Whether substitution proposed will fit into space allocated without necessitating <br /> changes in details and construction of related work. <br /> <br /> 8. Whether substitution is otherwise in the Owner's interest, offering advantages <br /> in cost and time to the Owner. <br /> <br />2.04 DOCUMENTATION <br /> <br /> A. The Contractor shall support his substitution submittal with sufficient <br /> information, test data, certificates, samples, or other means to permit the Architect's <br /> making fair, equitable, and informed judgments. <br /> <br /> B. The burden of proof that substitution is equal or otherwise acceptable shall be <br /> upon the Contractor. The Architect may withhold or refuse approval for reason of <br /> insufficient documentation. The Architect may also require additional tests and <br /> inspections for which cost the Contractor shall be responsible. <br /> <br /> C. Where agencies such as the State Department of Health, State Fire Council, <br /> International Conference of Building Officials, or local Building or Fire <br /> Departments exercise jurisdiction over use of specific material or method, the <br /> Contractor shall submit certification of their approval of proposed substitution <br /> concurrently with substitution submittal. <br /> <br />2.05 TIME LIMITATIONS <br /> <br /> A. The Contractor shall propose his substitutions in writing to the Construction <br /> Manager not later than 30 days after award of Conwact and include complete <br /> documentation. <br /> <br /> Section 01600 <br /> Page 34. <br /> <br /> <br />
