Submit as required to document acceptability of substitutions proposed. <br /> <br />PART 2 - PRODUCTS <br /> NOT USED <br /> <br />PART 3 - EXECUTION <br /> <br />2.01 REQUIREMENTS FOR PROPOSING SUBSTITUTION: <br /> <br /> A. Proposal to substitute product, material, equipment item or system equal to that <br /> specified will be considered for review where one or more products is specified <br /> by manufacturer's trade name or other product designation and is qualified by the <br /> phrase "or equal". <br /> <br /> B. Prior to submitting proposal to substitute equal product, material, equipment, or <br /> system, the Contractor shall have satisfied himself that both proposed substitution <br /> equals or exceeds that specified and shall have informed himself sufficiently of the <br /> Architect's requirements to be able to propose substitution in good faith. <br /> <br /> C. Substitution submittals by Contractor(s) which do not meet the stated standards for <br /> substitution consideration will be subject to backcharging of the Contractor(s) by .the <br /> Construction Manager for the cost of Construction Manager's and Architect's rewew <br /> and handling at their prevailing hourly rotes. Such charges shall be deducted from <br /> Contractor's current application for payment. <br /> <br />2.02 THE CONSTRUCTION MANAGER'S REVIEW <br /> <br /> A. The Construction Manager, acting as the Owner's designated agent for the coordination <br /> of construction activities for this Project, shall be the sole judge of whether the <br /> Contractor's proposed substitution is complete and correctly prepared prior to its <br /> transmission to the Architect and Owner for review in accordance with the following <br /> criteria: <br /> <br /> 1. Whether substitution proposed is allowed by applicable section of the <br /> specifications and conforms with description or performance specified. <br /> <br /> 2. Whether substitution proposed contains sufficient supporting documentation with <br /> which to determine acceptability. <br /> <br /> 3. Whether substitution proposed is submitted in such a timely manner that will not <br /> adversely impact the progress of the work. <br />2.03 THE ARCHITECTS REVIEW <br /> <br /> Section 01600 <br /> Page 2-4 <br /> <br /> <br />
