2. A detailed plan of the excavation area and the impact on ~ <br />existing right- f-way and infrastructure. No claims for <br />delay will be p rmitted. <br />CONTRACTOR electing o utilize a Trench Box must submit physical <br />dimensions, material , position in the trench, expected loads, <br />and the strength of he box. No claims for delay will be permit- <br />ted. <br />CONTRACTOR electing o utilize Shoring, Sheeting, and Bracing <br />must submit dimensio s and materials of all uprights, stringers, <br />cross-bracing, and spacing required to meet OSHA requirements. <br />No claims for delay ill be permitted. <br />SAFETY PROGRAM: Th CONTRACTOR shall submit a safety program <br />specifically for th construction of trench excavation. The <br />trench safety progr m shall be in accordance with OSHA standards <br />governing the prese ce and activities of individuals working in <br />and around trench e cavation. <br />INSPECTION: The CO TRACTOR shall make daily inspections of the <br />Trench Safety Syste s to ensure that the systems meet OSHA <br />requirements. Dail inspection is to be made by a"competent <br />person" provided by the CONTRACTOR. If evidence of possible <br />cave-ins, or slides is apparent, all work in the trench shall <br />cease until the nec ssary precautions have been taken by the <br />CONTRACTOR to safeg ard personnel entering the trench. It is the <br />sole duty, responsi ility and prerogative of the CONTRACTOR, not <br />the OWNER or the EN INEER, to determine the specific applicabili- <br />ty of the designed rench Safety Systems to each field condition <br />encountered on the roject. The CONTRACTOR shall maintain a <br />permanent record of daily inspections. <br />INDEMNIFICATION: T e CONTRACTOR shall indemnify and hold harm- <br />less the City, its mployees and agents, from any and all damag- <br />es, costs (includin , without limitation, legal fees, court <br />costs, and the cost of investigation), judgments or claims by <br />anyone for injury o death of persons resulting from the collapse <br />or failure of trenc es constructed under this Contract. <br />The CONTRACTOR ackn wledges and agrees that this indemnity <br />provision provides indemnity for the City in case.the City is <br />negligent either by act or omission in providing for trench <br />safety, including, but not limited to inspections, failure to <br />issue stop work or ers, and the hiring of the CONTRACTOR. <br />MEASUREMENT: Tren h Safety Systems shall be measured by the <br />linear foot along he center line of trench, including manholes <br />and other line str ctures. <br />PAYMENT: Payment or Trench Safety Systems, measured as pre- <br />scribed above, sha 1 be made at the unit price bid per linear <br />foot of "Trench Sa ety Systems". Payment of all work prescribed <br />under this item shill be full compensatian for the Trench Safety <br />409 <br />
