Sept. 1, 1995. <br />SUBCHAPTER E. NEIGHBORHOOD ENTERPRISE ASSOCIATIONS <br />§ 2303.301. Organization of Neighborhood Enterprise Association <br />(a) Individuals residing in an enterprise zone may organize a neighborhood enterprise association. <br />(b) Only one association may exist for a geographic neighborhood area. <br />(c) The association must: <br />(1) be a nonprofit corporation organized under the Texas Non-Profit Corporation Act (Article 1396- <br />1.01 et seq., Vernon's Texas Civil Statutes); and <br />(2) be eligible for federal tax exemption under Section 501(c) of the Internal Revenue Code of 1986 <br />(26 U.S.C. Section 501(c)). <br />(d) The articles of incorporation must: <br />(1) describe the geographic neighborhood area of the association; and <br />(2) authorize the association to engage in business only in the enterprise zone in which the <br />neighborhood area is located. <br />(e) The incorporators shall publish in a newspaper of general circulation in the governmental entity or <br />entities that applied to have the area designated as an enterprise zone an explanation of the proposed <br />association and the incorporators' rights in the association. <br />(f) A copy of the association's articles of incorporation and bylaws shall be available for public <br />inspection at: <br />(1) the office of the city manager or comparable municipal officer if the entity is a municipality; or <br />(2) the county judge's office if the entity is a county. <br />Added by Acts 1993, 73rd Leg., ch. 268, § 1, eff. Certification of Association <br />(a) After a neighborhood enterprise association is organized, the association's board of directors must <br />apply to the governing body of the enterprise zone or to the department for certification as a <br />neighborhood enterprise association. <br />(b) The governing body of the enterprise zone or the department may not grant certification unless <br />the association has hired or appointed a suitable chief executive officer. <br />Added by Acts 1993, 73rd Leg., ch. 268, § 1, eff.
