ERI Consulting, Inc. <br /> <br /> 1.5 SUBCONTRACTOR: A person or organization who contracts under the Contractor <br /> for the performance of part or all of the Contract between the <br /> Owner and the Contractor. The Subcontract may be direct with the <br /> Contractor or with another Subcontractor. <br /> 1.6 PROJECT: The term "Project" shall include the construction of any building <br /> or any structure or any facility or any utility appurtenant thereto, <br /> including original equipment and original furnishings thereof, and of any <br /> addition to, alteration, rehabilitation or repair of any existing building <br /> or any structure, or any facility or utility appurtenant thereto. <br /> <br /> 1.7 WORK: All labor, materials, facilities, and all other things which are <br /> required by the Contract Documents. <br /> <br /> 1.8 DATE OF SUBSTANTIAL COMPLETION: The date of Substantial Completion of the <br /> Work, or designated portion thereof, is the date jointly certified by the <br /> Engineer/Project Manager, Owner and Contractor when construction is so <br /> sufficiently complete, in accordance with the Contract Documents, that the <br /> Owner may utilize the work, or a designated portion thereof, for the use for <br /> which it is intended. <br /> <br /> 1.9 THE CONTRACT SUM: The Contract Sum is the total compensation payable to the <br /> contractor for performing the Work as originally contracted, or as <br /> subsequently adjusted by contract modifications. The Contract Sum shall be <br /> the total price as provided by the contractor in the contractor's original <br /> proposal and shall include all sales tax, fees, permit fees, etc. <br /> <br /> 1.10 WRITTEN NOTICE: Written Notice shall be considered to have been duly given <br /> if delivered in person to the individual or member of the firm or to an <br /> officer of the corporation for whom it is intended, or if delivered at or <br /> sent by registered or certified mail to the last business address known to <br /> him who gives the notice. <br /> <br /> ARTICLE II. LAWS GOVERNING CONSTRUCTION <br /> <br /> 2.1 COMPLIANCE WITH LAWS: In the execution of the Contract, the Contractor must <br /> comply with all applicable State and Federal laws, including but not limited <br /> to, laws concerned with labor, equal employment opportunity, safety, minimum <br /> wages, asbestos abatement and asbestos worker protection. The Contractor <br /> shall make himself familiar with, and at all times shall observe and comply <br /> with, all Federal, State and Local laws, ordinances and regulations which <br /> in any manner affect the conduct of the Work, and shall indemnify and save <br /> harmless the Owner, his heirs, and successors against any claim arising from <br /> <br />_ 4/~1/03 2 <br /> <br /> <br />
