If <br /> you are satisfied with this agreement, you give up your <br /> right to dispute the amount due under the agreement <br /> except for the utility's failure or refusal to comply with <br /> the terms of this agreement." <br /> (iii) A deferred payment plan may include a one-time five percent <br /> (5%) penalty for late payment on the original amount of the outstanding <br /> bill with no prompt payment discount allowed except in cases where the <br /> outstanding bill is unusually high as a result of Company's error (such as <br /> an inaccurate estimated bill or an incorrectly read Meter). A deferred <br /> payment plan will not include a finance charge. <br /> (iv) If Customer has not fulfilled terms of a deferred payment <br /> agreement, or does not fulfill the terms and obligations of a level or <br /> average payment plan, then Company will have the right to disconnect <br /> service to Customer pursuant to the Discontinuance of Gas Service <br /> provisions in these Service Regulations; and, under such circumstances, <br /> Company will not be required to offer a subsequent negotiation of a <br /> payment agreement prior to disconnection. <br /> (c) Residential Level Payment Plan <br /> Company may offer a level payment plan, which, if offered, will allow Residential <br /> Customers to pay one-twelfth of the Customer's estimated annual charges (or, <br /> for a new Customer, an estimate) at the appropriate Customer class rates each <br /> month, with provisions for annual adjustments as may be determined based on <br /> actual gas use. <br /> (d) Residential Average Payment Plan <br /> Company may offer an average payment plan, which, if offered, will allow <br /> Residential Customers to pay one-twelfth of the sum of the Customer's current <br /> month's charges plus the previous 11 months' charges (or, for a new Customer, <br /> an estimate) at the appropriate Customer class rates for each month, plus a <br /> portion of any unbilled balance. <br /> (e) Deposits for Level and Average Payment Plans <br /> Company may require a deposit from all Residential Customers entering into <br /> level or average payment plans pursuant to the requirements of these Service <br /> Regulations. Company will include the amount already deposited by Customer in <br /> calculating a deposit required under this paragraph. Company will pay interest <br /> on the deposit as provided for in these Service Regulations, and may retain the <br /> deposit for the duration of the level or average payment plan. <br /> (5) Disputed Bills <br /> (a) In the event of a dispute between Customer and Company regarding any <br /> bill, Company will make such investigation as is reasonably required by the <br /> particular case and report the results thereof to Customer.
