He submitted a Minor Plat of the property to the Coniission4 <br />There was no opposition present and after discussion, Mr. Thornton made a <br />motion that the petition be recc4mended for approval. Dr. Miles seconded <br />the motion and all voted aye. <br />The next item was to consider approval of a Preliminary Plat of Town East <br />Estates. Mr. Oo Lo Rainey, owner of the property was present, and stated <br />that he wanted to develop the subdivision which provides for the extension <br />of East Houston Street to 34th N.E. between Lamar Avenue and Robin Road. <br />A memorandum from the Director of Public Works dated May 5, 1975 was sub- <br />mitted stating the plat conformed to the subdivision Ordinance except for <br />the depth of the proposed lots. A 100 foot minimum is required by the <br />Zoning Ordinance but due to the shape and size of the property, 10 of the <br />18 lots would have a depth of 8605 feet. <br />Mr. Rainey presented arguments that the property could be developed with <br />shallow lots and offered guarantees that the proposed houses would be <br />comparable to those existing in the arei:- <br />There was a large audience present and Mr. 14ebb Board spoke for them <br />opposing the plat due to the shallow lots and the possibility that the <br />de=velopment of the subdivision would devalue adjacent property. <br />The discussion pointed out that if the Coinission approved the plat, they <br />would in effect be approving a lot depth less than the Zoning Ordinance <br />required. This can only be done by the Board of Adjustment and Dr. Gilmore <br />moved to deny the plat due to substandard let depth. Mr. Staples seconded <br />the motion and all voted aye. <br />Mr. Rainey was informed that he could make an appeal to the Board of <br />Adjustment on this matter and should they approve the variance, the plat <br />would be reconsidered. <br />With no further business appearing the meeting was adjourned. <br />e No McCallum <br />ecretary, Ex-Officio <br />
