Page 2 Board of Adjustment - 6/20/91 City Attorney Haynes further stated, that as Mr. Burgin said the Board of Appeals, the City Council, has the authority in this matter to grant the variance. After discussion, a motion was made by Councilman Burnett, seconded by Councilman Shelton granting the variance to the property located at 1418 N. W. 19th Street, belonging to Toby Yoder. The motion carried 7 ayes, 0 nays. Mayor Fisher called for consideration of and action on the request of Paris Junior College for deviations from current City policies for a variance of the requirements of the Fire Code on the south side of the railroad and east of the U. S. Army Reserve Center for construction of an Agriculture Barn. City Attorney advised the Board that this structure is a shed, it has no sides, steel poles, with a steel roof, and there is really nothing to burn, and because of that fact the cost of putting a fire hydrant near it is not justifiable. City Attorney advised that the Fire Code addresses this issue, stating the fire official can made such decisions, where there are no hazards would certainly be a situation where the Board could authorize the structure without having a fire hydrant placed close to it. Mr Burgin also addressed the issue endorsing what City Attorney Haynes had advised, and stating that if the College encloses the building, if they begin using it in any other manner, other than an open livestock building, then at that time it would have to meet code. Rick Thomas representing Paris Jr. College, was present appeared before the Board in support of the variance. After discussion, a motion was made by Councilman Bell, seconded by Councilwoman Smith for approval of the variance for the Agriculture Barn of Paris Jr. College. The motion carried 7 ayes, 0 nays.
