Mayor Fisher called for proponents to appear, and Mary Hurd, 2440 40th S. E., appeared before the council in behalf of the' petition, and presented a petition signed by homeowners in the area. Jerry Hurd also appeared before the Council stating that he is in favor of having open carports, that it would increase the. value of the property along with providing protection for automobiles. Ercille Gray, 2460 40th S. E., was present telling the Council that she would also like to have a carport on her property, that it would help protect her car, and in bad weather she would not have to get out in it. Mayor Fisher called for opponents to appear, none appeared, and the public hearing was declared closed. Councilman Bell said he was in favor of this zoning change, but questioned why this neighborhood could do this, then all the neighborhoods in Paris could do this. Mr. McCollum explained that this area is zoned Community Development which allows you to vary the yards under special permit, and they have complied with that, and got a special permit to have a zero side line. After further discussion, a motion was made by Councilman Shelton, seconded by Councilman Bell authorizing preparation of an ordinance permitting this zoning change to be presented at the next regular Council meeting. The motion carried 6 ayes, 1 nay, Councilman Booth voting nay. Mayor Fisher declared the public hearing open to consider recommendation on the proposed abandonment of the Old Paris Clarksville Road from a point approximately 500 feet east of 34th S. E. and Clarksville Street intersection, east of Loop 286 S. E. No one appeared for or against this matter, and the public hearing was closed. City Attorney Haynes informed the Council what brought this about was the Highway Department who wished to get rid of this right -of -way, they had a push to get rid of all of the property that they. did not need, and this showed up in their ownership of property not - needed. We are only acting as a vehicle to assist the Highway Department. City Attorney Haynes said as far as he knew, the City does not need to retain the right -of -way for any reason. Earl Smith, City Engineer said he would have to take a look at the property and determine if the right -of -way is needed. After discussion was had, a motion was made by Councilman Shelton, seconded by Councilwoman Ingram to table this item until after executive session. The motion carried 6 ayes, 1 nay, Councilman Burnett voting nay.
