3 <br />Chairman Nutt declared the public hearing open on the proposed <br />abandonment of the Old Paris - Clarksville Road from a point <br />approximately 500 feet east of 34th S.E. and Clarksville Street <br />intersection, east to Loop 286 S.E. <br />No one was present in the audience to speak on the matter and the <br />public hearing was closed. <br />Mr. McCollum explained to the Commission that the Texas Highway <br />Dept. had requested the City's cooperation in abandoning the <br />subject R.O.W. in order to dispose of excess land created when the <br />highway was realigned some years ago. <br />Mr. Clifford expressed his feeling that the public right of way <br />should not be abandoned citing the lack of cooperation in the past <br />from one of. the involved land owners, relative to an easement <br />across his land. <br />Following discussion Mr. Clifford made a motion to recommend the <br />City not abandon the right of way. Mr. Powell seconded the motion <br />which carried "8 ayes, 0 nays. <br />The Commission next heard discussion on the proposed drainage ditch <br />improvements in connection with the Mirabeau Square Shopping Center <br />expansion. <br />Brad Bankhead, 235 S.E. 35th, presented a statement signed by 12 <br />property owners on 35th S.E. requesting consideration be given to <br />the preservation of trees and vegetation, that forms a green belt <br />between the shopping center and their homes, in the construction <br />of the concrete lined drainage ditch. <br />Earl Smith, City Engineer, advised the Commission that the <br />construction plans for the drainage ditch followed the latest Site <br />Plan for the shopping center and would relocate a portion of the <br />ditch closer to the homes on 35th S.E. He said that there was no <br />engineering problem in leaving the ditch in its present location, <br />but the owner of the land should be made aware of such a change. <br />Mr. Hay-ter advised that some trees would be lost even if the ditch <br />remains in the present stream bed. <br />Discussion followed and it was .a consensus of the Commission that <br />the City Council should discuss the matter at their Thursday <br />meeting and take any action necessary. <br />
